To Whom It May Concern, I'm writing this letter because as a customer I feel my rights have been violated. My wife and I signed for a three-year membership with GOLD's GYM in Clarksville, TN. I found out this month that GOLD's GYM is no longer in business and new owners (Brian or Karl) took over the GYM with a new name being: EXTREME FITNESS. As a member to GOLD's GYM no notification was ever sent through the mail or a phone call placed to inform our family of such a change.
When I signed the contract I did so for the membership of GOLD's GYM and not EXTREME FITNESS. I'm sure there are other GOLD's GYM members who did not receive notification of this restructure. Also, the enclosed contract states that if there is no GOLD's GYM within a fifteen-mile radius this becomes null and void. It upsets me that EXTREME FITNESS did not notify me of this change nor offer a new contract under EXTREME FITNESS. I'm seeking to cancel my membership along with my wife to GOLD's GYM and seek back pay for the drafts EXTREME FITNESS took out of my checking account with out a contract with them ($58.00 per month).
Also, a letter to all past GOLD's GYM members allowing them to make the decision to cancel or resign under EXTREME FITNESS. As a side note: Every business who had restructured that I was a customer with always notified me, which wasn't the case in this situation. I appreciate your help in this matter. THANK-YOU, ERIC J.
