My daughter was hit in the front end while she was stopped at a stop sign in 2001. It was during a popular public event, so fortunately 2 police officers witnessed the accident.
The driver was in a stolen Hertz rental, which had been reported stolen over 30 days before the accident. My daughter's vehicle was on a joint policy with me, with State Farm. I had insurance with them for over 10 years.
Hertz refused to pay for the damage because the car that hit my daughter was stolen, so they said they were not responsible.
State Farm said that they were not responsible because Hertz should pay, but that they could understand why they would not because the vehicle was stolen........at the court date, the girl that hit my daughter asked for a jury trial, since that was her constitutional right. When the trial came around, she did not show up and she had moved with no forwarding address!
State Farm canceled our policy, claiming that the reason they canceled was because of a 2 point ticket I had received the year previously. They did not mention the accident on the cancellation notice at all, but we really know that was why they did it!
I was already 3 days into the cancellation, when I received the notice and that same afternoon, a policeman came to my home and removed the tag from my auto because State Farm reported their cancellation to the highway department.
I cost me $200.00 to get it back and to get new insurance, it was now going to cost me double, because I did not have continuous coverage.......and now my daughter pays an enormous car payment on a wrecked Mitsubishi 3000 GT.
Where is the justice in all of this!

This does not add up. If the rental car was stolen, State Farm should pay the claim, and subrogate the person driving the stolen car.
