2002 Chevrolet S10 considered a lemon by the TN state law.

 

We purchased a vehicle from Chevrolet new on 2-9-2002. Since then, on 9-27-02 we have had continual problems with the rear-end of the truck. (We do not tow anything) The first problem, the rear differential had a sealed unit, which came defected from the manufacturer with an extra gasket that sealed it. Therefore, it was allowing water to get into this sealed unit.

 

Chevrolet "fixed the problem" on 9-27-02. Then the rear end was making the same noise again & we took it to another dealership closer to work. On 1-17-03, this dealer said there was a problem with the differential again. They "rebuilt" it for a 2nd time. Then the noise came back on 1-21-03. The same problem, the dealer "rebuilt it" again for the 3rd time. Then on 2-9-03 There was a rear main seal leaking oil from the engine. They fixed that. Also the noise from the rear end was back.

 

They fixed it again for the 4th time. Then on 1-27-03 the dealership decided to replace the complete rear end because it was still defected. On 2-13-03 we took the truck in again to have all new rear end put on for the 5th time of service on that part. We contacted Chevrolet's 800# for customer service. They agreed to cover the rear end up to 7 years or 100,000 mile with no deductible.

 

We currently have 29,000 on it in one year. It again is making the same noise with the rear end again and we have not taken it back yet to be fixed for the 6th time. The Chevrolet place tell us we have no complaint to file with the lemon law. It has been serviced 5 times for the same problem & still is not correct. Also, we did have an oil leak. I did tell the customer service they should provide a bumper to bumper warranty which would be cheaper than replacing the truck.

 

The representative at GM's 800 # was very rude & would not return phone calls like she promised. When she did come up with a half way decent offer she said we had 5 minutes to decide or it would not be offered. My husband told her she took 4-5 weeks we can take a week or two to decide. If we did decide to take it, we had to tell her we were completely satisfied with Chevrolet.

 

Even if we weren't. That way we could not pursue the suit of the lemon law, which protects the seller not buyer. She threaten us not to pursue the lemon law because we would not win, & GM would not uphold the 7 year extended warranty on the rear-end.

 

I told her I wanted a bumper to bumper warranty for 100,000 miles or a new truck. She could not authorize that & would not let me speak to her supervisor under any circumstances. After talking to attorney, the cost for us to pursue is too great at this time. The dealership has been very good at doing the best they could to a point.

 

Stuck with a lemon!!!
