RE: Esquire Insurance Agency - cancelled car insurance policy - verbally told must forfeit entire $ 605 deposit

I bought a Maxima on June 14th, 2003 from Major World, a car dealership located in Long Island City. The car is fine but I took out the insurance on it from Esquire Insurance Agency, an insurance broker that was located on the same lot as the dealership where I purchased my car.

My current insurance company, State Farm, was closed on the weekend, so I went to my broker on Monday to insure my car and to cancel the insurance that I took out on Saturday. I faxed Esquire to ask for a refund.

Frank Scivoletto informed me that I was not entitled to one. The papers that I signed with Esquire stated that I would lose 10% of the total amount if I cancelled the policy early. I gave him $605.00 as a deposit. Since the total cost of the policy was $2,742, I thought that I would lose $274.20 as a result of the early cancellation.

However, Mr. Scivoletto informed me that I would have to forfeit the entire deposit, despite the fact that I only had the policy for two days. I believe that paying $605 for such a short period of time is outrageous.

I would appreciate your assistance in this matter.

Sincerely,

Patrick O'Sullivan
