RE: Dodge City Toyota, Inc. - won't perform warranty work to Toyota 4-Runner as car wasn't purchased there I purchased a new Toyota 4-Runner from Jeff ONeal Toyota as they had the best price. I now have some minor warranty work that needs to be done. The local Toyota Dealership, where I live and work will not do the warranty service, as I did not purchase it from Dodge City Toyota. Under Kansas State law, can they refuse to do warranty if they are a new vehicle dealer for the first stage manufacturer? Do they have to sell the vehicle in question to be required to do warranty work that is covered in the warranty promise? In doing research on this, I found: K.S.A. 8-2401 Chapter 8.--AUTOMOBILES AND OTHER VEHICLES Article 24.--LICENSURE OF VEHICLESALES AND MANUFACTURE (b) "New vehicle dealer" means any vehicle dealer who is a party to an agreement, with a first or second stage manufacturer or distributor, which agreement authorizes the vehicle dealer to sell, exchange or transfer new motor vehicles, trucks, motorcycles, or trailers or parts and accessories made or sold by such first or second stage manufacturer or distributor and obligates the vehicle dealer to fulfill the warranty commitments of such first or second stage manufacturer or distributor. I have been in contact with Toyota National about this and they have looked into the matter. They have expressed their regret on the matter. At this point in time, there is nothing they can do according to their telephone representative other than place this complaint in the dealerships file. I have enclosed a copy of my response to Toyota National. Note that both Toyota National and I have been in contact with the owner of the dealership in question, so it is no mistake. This dealership (Dodge City Toyota, Inc.) has interests in five Toyota dealerships in Kansas and interest in other car and truck dealerships in Kansas. Is it possible that with a recession in effect, that we can expect more new car dealerships in Kansas to put this buy here requirement into effect?
Does that mean than when a Kansas resident changes their residency, they may still need to take it back to the dealership they purchased it from? Be that as it may, what are the legal requirements, under Kansas State law, for a new car dealership to honor or fulfill the warranty commitments of such first or second stage manufacturer or distributor. This car is titled under Lowell A. Brakey. Anyone else having problems like this?
