My husband and I bought a new Phillips home in Mt Juliet TN, right outside of Nashville in September 2000. We have had problems with it from day one. The windows all leak and some to the extent of the drywall crumbling away from around them. There is mold in the home from all the mositure. The carpet is damaged.

 

Our original walk through list was never completed, nor was the 90 day walkthrough, or the one sent to them at the end of 6 months. At the end of a year a list was sent, and it too, has not been addressed or completed. The builder did some drywall work in August of 2001 and attempted to repair leaky windows that are installed wrong by caulking.

 

The crew damaged a sofa, tore a rug, broke a flower vase, broke a candle sconce, chipped a Bombay mirror, broke a Bombay table, got paint on a big screen tv, paint oncarpet in the hall, dining room, piano room, upstairs bedroom, bonus room and paint also on hand rubbed cherry bedroom suit, an antique rocker, on custom bedspread and drapes, paint on a shower curtain and towel, and paint on the master bedroom suit, and paint on a piano bench in an upstairs bedroom.

 

Drywall dust damaged a 21 inch computer monitor, a pentium computer, 2 hard drives, and a pentium II 450. Their repair work was fruitless. Apart from doing an extreme amount of damage to our property, the problems came back. The mortar is crumbling away from a pedestrian door in my garage. The sheetrock in the garage has moisture damage on it. There is a terrible moldy odor coming from my kitchen sink. In the warm months my central air has an odor so replusive, it is difficult to stay inside.

 

Our heating and cooling bills have esculated due to the poor quality of windows. The seal is broken on two of them. Most of them can not be opened, and the ones that can, have the balasts either broken or loose. I now smell sewer gas in my garage and the pipe seems to be loose from the wall. It is the worst nightmare ever. I now have mold allergies and have to recieve weekly shots and take medication daily. The stress is literally killing me. My TMJ has never been worse due to the stress of this home.

 

Our lawyer is trying to proceed with arbitration to get the home repaired but the company tells him I am just extremely picky and can never be satisfied. Do all new homes have such large cracks in the corners and around doors? Ours also has nail pops bursting out in every room. I have had the air tested and it does show mold. Birds are in the dryer vent.

 

I asked for the dryer vent flap to be repaired the first month after living in the home. Now it is a fire hazzard. I am having an architect and structural engineer to tell me what is actually wrong with the home. All we ask is to have what we were told we were buying, a quality home. We want the same quality home our neighbors have. We want our house remedied and our costs reimbursed.

 

We want compensation for the medical conditions now arising because they did not address the water intrusion issue properly over a year ago, which now causes mold allergies. Can you help us get our home fixed? Anyone requesting more information can email Email User
