R.C. Willey Furniture Store, Henderson, Nevada R.C. Willey Furniture Store, Henderson, Nevada November 5, 2005 I bought several items from R.C. Willey furniture store as I am remodeling my home. I went to pick up a pair of end tables. I backed up my brand new truck with only 700 miles on the odometer to the loading dock, and I didn't hit the wall. When the warehouse employee arrived with the furniture I dropped the tailgate and asked if I was close enough. He said no and he said he would guide me back closer. I put the truck in reverse but I didn't have to release the clutch because I started to roll back when I eased off the brake. With my foot on the brake I looked at the warehouse employee in the rear view. Mind you, I can't look at the wall when I'm looking at him. He made a fist and I pushed on the brake immediately. I hit the wall at the same time. I need a new tailgate. I called the General Manager, who in turn did not return my call. Instead, he brought the salesman who sold me the furniture into his office to rip him a new one for signing the release of liability rather than having me sign it. Apparently, the salesman didn't know any better because he was new and when I stepped away from the counter he went ahead and signed the release. The release states that R.C. Willey is not responsible for any damage to the vehicle or furniture that THEY cause! After getting the run around from several R.C. Willey employees, I was told by their claims department that it was my fault because I was driving. I explained that I hadn't hit something in fifteen years and I wouldn't have hit the wall if their employee was paying attention. I had already backed the truck up without hitting the wall. The employee insisted that I back it up further. They have the whole thing on tape from their security cameras, but they still won't take responsibility. I put lettering on the back of my truck that states: Buyer Beware. Don't Shop at R.C. Willey. An R.C. Willey employee caused this damage to my truck. R.C Willey is refusing to pay for the damages. Please call Kara with the Claims Dept. 632-3670 and tell her to repair Ms. Carr's new red truck. After Kara received a few calls she finally called me to tell me that my friends were harassing her and that she may press charges. I told her that they weren't my friends, just concerned citizens. She still refused to take responsibility even with her phone number on the back of my truck. I faxed a copy of a picture of the lettering on my truck to R.C. Willey's corporate office and explained that I found the Better Business Bureau's website has a Buyer Beware rating for the Henderson store for not answering at least two complaints (not mine) with them. I told R.C. Willey that I would be happy to go to the BBB office and read their file to find out exactly how many complaints they have and put that information on my truck as well. I got a call that same day from their insurance adjuster who sent me to get an estimate with a collision repair shop. That was almost two weeks ago and I still haven't heard back from R.C. Willey as to whether they are going to repair my truck. If R.C Willey would treat me this way, they will treat all their customer's this way. They didn't repair my friend's Stepfather's truck either. I will continue to notify the community that R.C Willey doesn't value their customer's and they don't take responsibility for the negligence. R.C. Willey doesn't deserve to be in business with these policies and poor business practices. How dare they damage what I've worked hard for and refuse to take responsibility. I am a commercial driver, Nevada CDL, millions of miles behind the wheel as well as a Private Pilot for just over 30 years and when you are in command of a vehicle, anything and everything that happens to that vehicle which is under your control is your fault/responsibility. It can be an accident, a misadventure or an intentional act, but regardless, it is your duty as the driver in command of that vehicle to make sure it does not hit the wall. It is your responsiblity to select a qualified spotter when backing a vehicle into a bay. If you as the driver in command of that vehicle elect to choose a saleman whom very likely has very limited experience in driving himself, let alone being a spotter for backing a vehicle into a stall... if you assigned the tast of spotting to the salesman, then it is your responsibility. --- As your mother told you when you were a kid, "If the salesman told you to drive through a wall, would you do it?" In fact... that's exactly what you did. It's not R.C. Willey's fault that you used poor judgement when assigning the spotting duties of backing your car into a stall to somebody inexperienced in doing so. --- And NO! I am NO FAN OF RC WILLEY, in fact... I have my own list of complaints about the company, but if I run my car into their wall because somebody told me it was okay to move backward... It will be my fault also, as it was yours. -- Learning to drive is more than steering and pedaling. The salesman did not hit the wall, THE DRIVER DID!!!! --- Had you been on public property instead of private, HPD or METRO could have cited you for "DUTY" which is the local term for "Failing your duty to avoid an accident." It's your duty as the driver in command of the vehicle to make sure, take steps required, ensure without excuse that your vehicle under your command be safe and avoid accidents and incidents.You failed that "DUTY" and now you want to place the blame on the salesman. --- You say you backed up far enough. Then why on earth would you back up more, just because a salesman told you to? Who is in charge of the vehicle? YOU ARE!!! YOU MAKE THE CALL both legally and logically. YOU decided to back up further than you had already evaluated to be enough (in your own words). You were satisfied with the distance you were from the wall. Decided that was good enough. Why then did you allow ANYONE to tell you to drive closer when you believed you were close enough already? ----------- At that point it is YOUR DUTY as the DRIVER IN COMMAND OF THE VEHICLE to secure the vehicle, get out and take a look for yourself to see what the conditions were. That is the DUTY and the RESPONSIBILITY OF ALL DRIVERS!!!! That is NOT a SALESMAN'S responsibility. ---- Grow up! Learn to drive! Stop placing the blame for your own poor judgement on others. It was YOUR poor judgement that allowed you to back up further at the direction of a SALESMAN when you in your own words say you belived you were close enough.
