Virgin Active / Johannesburg, South Africa Virgin Active / Johannesburg, South Africa November 29, 2005 Virgin Active Fourways Mall Shopping Centre Fourways Boulevard Fourways Gauteng South Africa Customer relations: Jacqui Wadge Managing Director: Chris Rolfe Complaint is as follows: I entered an agreement for the period of 1 year, 7th January 2002, payment made directly by bank debit. Agreement for 1 year terminating 31st January 2003. However my bank debit has been running ever since. I became aware of it during November 2005. I contacted Jacqui Wadge (Customer Relations) and Chris Rolfe (Managing Director), requesting my over-paid money back. I was referred to small-print in my contract that stated that the contract "auto-renews". However the contract small-print also states the contract runs for a period of 1 year. I find this mis-leading and ambiguous, and when I researched a local complaints web-site (http://www.hellopeter.co.za) I found many people have fallen into this trap. During that 3 year period when my contract was expired, I never received a single phone-call notifying me of the status of my account, which was being paid in full, and yet had I tried to access the facility, I would have been denied as my access card was expired. I am seeking my debited funds for that period to be returned to me. Jacqui claims I was notified by post. I don't recall receiving any such notifications, else I would surely have halted the debit from my account. Virgin Active are legally protected by their fine-print, but their actions are extremely dis-honourable and likely criminal in intent. Not all cons are illegal, but intention to swindle people out of cash is illegal. I have been in contact with both Jacqui Wadge (Email User) and Chris Rolfe (Email User) on various occasions in an attempt to resolve this issue, and as of today (11/29/2005), they are firmly committed to offering me 1 years free membership in return for my money. I do not want their services and have declined this offer. In my opinion, this contractual fine-print is a con.
