Vacation Homes Unlimited / Super Nova Group Vacation Homes Unlimited / Super Nova Group November 28, 2005 To Whom It May Concern,
My family and I moved to Las Vegas October 1st looking to rent a vacation home long term. We contacted Vacation Homes Unlimited/Super Nova Group by email and Andres Calvo responded by email saying they had several properties. We arranged to view one and decided to rent it.The agent, Bruce Peterson, told us it would cost $10,733.25 in pre paid rent, I gave him $8,000 in cash with a promise to pay the rest when we signed the lease. They put off the signing twice, the second time at their office, saying it wasn't ready yet. Andres Calvo had me sign a reservation request instead and asked for the rest of the money, I gave him a check for the balance and we left. That was Oct. 14th, 2005 at appox. 3:30 pm. Over the weekend we changed our minds, we wanted a larger house, and first thing Monday morning Oct.17th, I called, faxed and emailed our cancellation, less than 24 business hours later. I received no response until Wednesday Oct. 19th at which time Bruce Peterson called and informed me that he could only give us half of our money back. I told him that was not legal and that I wanted the full amount back and he told me to sue him. The $300 dollar an hour attorney we consulted looked at the paperwork and emails to and from the company and told us that they had no LEGAL right to keep ANY of our money. He also told me that it could take up to two years and cost between 3 and 5 thousand dollars to litigate. I had the attorney send Vacation Homes Unlimited a letter and have received no response. We can't afford to lose another 3 to 5 thousand dollars trying to litigate this, we have already had to use our son's college money to rent the place we are in now. I have contacted several consumer fraud agencies, the local media, our City Council, the Mayor, the Governor and a Congress Woman, all to no avail. No one seems to care at all that these people just stole our money! This company certainly does not seem to be too concerned about being sued and why should they be? Even if we could afford the attorney and eventually got a judgement against these people there is no guarantee they will ever return our money. When there are no criminal consequences for stealing what is the incentive not to do so? Do you have ANY suggestions, any resources at all that can help us?
