We moved into a home in San Mateo, California and subsequently received a new phone number. On or about our 3rd day of residence we started receiving phone calls from the collection department of Capital One attempting to locate a women that we have not any knowledge of nor association with. It should also be noted that we are not a Capital One customer. We explained relentlessly to dozens of Capital One collection callers that we had just moved in and received the phone number that they were calling. The typical response from the Capital One collection callers was that they insisted that we put this mystery woman on the phone or inform her to call them. There were 6 to 12 collection calls from Capital One per day ranging from 6:00 AM to 10:00 PM. I insisted on speaking with a Capital One supervisor or manager. After explaining the situation to the Capital One supervisor and indicating that I believed that my California state consumer rights were being violated, the supervisor vehemently indicated that Capital One had every legal right to collect funds owed to them and that they would continue calling until the funds were received. The Capital One supervisor and some Capital One collection callers indicated that if I provided my name, mailing address and social security number that perhaps the calls could be rectified, however, I did not trust this situation as I suspected that providing this information would only lead to further entanglement with Capital One. The Capital One supervisor and some Capital One collection callers also indicated that if we paid our bills we wouldnt receive these calls. I am of German decent and my wife is Chinese. On multiple occasions, Capital One collection callers with southern accents took issue with my wifes spoken English and made comments that she should learn to speak English and to pay her bills. My wife was infuriated as she solely handles all of our finances and she is probably the most organized and timely bill payer on the planet. It also should be noted that my wife is a customer service manager for one of the largest corporations in the United States. My wife was less upset with the apparent racial discrimination on behalf of Capital One collection callers as she has become accustomed to it. As the daily Capital One collection calls continued throughout an entire month, the comments and attitude of the Capital One collection callers became more derogatory. After research, it was apparent that our only expedient option to stop the harassment, racial discrimination and slander from Capital One was to terminate our new phone number and to acquire an entirely new unlisted phone number.
