Complaint: I placed Motor Vehicle Retail Order with Gensinger Motors on 12/20/04. The salesman name was Frank Barone. I requested a 2005 New Beatle convertible, model GLS with the following:Aquarius Blue paint,Automatic Transmission, ESP,Cold Weather Package 2.0 Liter 4 cylinder engine Letherette Interior. I told them I need it for delivery before Christmas 2004. We agreed on a lease price of $318.16 per month and $1,582.36 due when I pickup the car. I left as $500.00 deposit. I was asked if they could not get me the GLS model would I consider the GL model, my reply was maybe, if it had all the same options listed above and could be delivered before Christmas of 2004. I was told that Roger Sudol would contact me. I called 2 days later and asked if he was able to get me the car. Roger's reply was no, and he asked me if I would be interested in taking the GL model instead of the GLS, I told him I would call my wife and see. When I called my wife she said she had called another dealer and he told her that the GL model does not come with the ESP safety package. This was a main selling point to us. I called Rodger back and told him that we needed the ESP package and since he could not get us the car as specified in the contract, I would like my deposit back.
He said to come in with a copy of the front and back of the cancelled check and the work order and I would get a check back. About 15 minutes later Rodger called again and said his sales manager said that since I would not accept the model GL, he would not return my deposit. My wife went to the dealership with all the documentation and the sales manager laughed at her and would not return the money. She requested to see the General Manager and was told he was not in. She immediately called me and I called the dealership while she was still at the location. The receptionist said that the General Manager was in. I left him a voice mail. I called Volks Wagon corporate headquarters and complained.
I would like my money back. Desired Settlement: Refund Settlement Explanation: I want my $500.00 deposit back, they are in breach of contract as they can not get me a GLS aquarius blue new beatle convertible with Automatic trans, ESP package, cold weather package, letherette interior by Christmas of 2004. They are trying to strongarm me into taking the GL model that does not have the ESP safty feature as listed as required in the work order, as we agreed upon. They want me to take the GL or lose my deposit. This is not a good way to do business and is not legal.
