Sometime during the week of 9/20/2004, while on holiday in Montreal, I was shopping with a friend at the following location: TAG Complexe Les Ailes 677, rue Sainte-Catherine oest, Local R-19 Montreal (Quebec) H3B 5K4 Heather, a sales associate, approached me and offered that I try on a few of the leather jackets that I was looking at. One jacket was purple and the other was black. A different sales associate was helping my friend. I tried on both jackets and said that I like the style of the black one but the color of the purple one. Heather said that they would make me a purple jacket in the same style as the black one and ship it to me with no problem. I told her that the black one (a size 10) was too tight in some areas. I tried on a larger size (a size 12) and it was too large in the shoulders. Heather said that it would be no problem to make the jacket in a size 10 but to add one inch on each side through the body of the jacket, keeping the shoulders the same size. I was worried about purchasing a jacket so far from home and having it shipped. Heather assured me that it would be no problem and that my satisfaction would be completely guaranteed. Meanwhile, my friend had selected another jacket to purchase. We began to negotiate a discount for purchasing both jackets and for paying cash in $US. The two sales associates made several phone calls to the person they identified as their boss and we finally arrived at a mutually agreed-upon purchase price and that the price would include all shipping. We paid cash for both jackets. My portion of the payment was $US375.00. My friend took his jacket with him and mine was to be shipped. Heather gave me the business card of Joe, her boss, and said that I should contact him if I had any problems. When we crossed the border back into the US, my friend turned in the original copy of the receipt in order to get a refund on the taxes. The jacket arrived several weeks after I returned home. Postage of $US21.00 was due on it (not according to the agreement). Although my weight and size is LESS than when I was on holiday (because of all the eating during holiday), the jacket (a size 10) is too tight. (In fact, it fit exactly like the black one in the store.) Additionally, the quality of workmanship is less than the jacket in the store. I phoned Joe to resolve the matter. He admitted that they had made the jacket without adding the one inch to either side and explained to me the difficulty of doing this and of importing the leather from Italy. Finally, he agreed to make another jacket if I would return the one I received. I said that I would do this if he would send me a pre-paid shipping label to return "mine" plus refund the $US21.00 that was erroneously charged for shipping. He said that he would call me back. He did not. I phoned Joe again. This time, he said that it would be too expensive to make the jacket over again. This time, he offered to refund part of my money. I told him that this was unacceptable since the jacket is too tight to wear. He said he would call me back. He did not. Since then, I have phoned Joe EIGHT times. Each time, he says he will call me back and then he does not. A few weeks ago, he even asked for my credit card number (which I gave to him). No refund has been posted to it.
