Liberty Wireless and Cellular Choices web sites. I am sending this information to all of the legitimate cellular carriers. Gentlemen, This letter will inform you of a deceptive business practice which is damaging to the reputations of your company, and may involve criminal and civil liability if you take no action to prevent the fraud after this notification. Liberty Wireless and Cellular Choices are working together to defraud customers using your company’s good name to establish what appears to be a legitimate business connection. Since your company is a known and respected brand, you should take action to prevent the use of your name to perpetrate this behavior. The way they work the scam goes like this. They send out postcards advertising a low monthly rate and no contract term. They get your credit card information over the phone and send out a defective phone with a preprinted return label. Upon activation, the customer finds that the phone does not work, whereupon they say just send it back and we will suspend your service until you have a working phone. At this point they have charged your credit card for the phone, gotten the phone back and charge you monthly for service that you can not get. The customer can not call them at the number that they give for customer service because they require information from the phone that they have gotten back in their possession. The phone prompts will not connect to them unless the customer has this information. They also can not accept cancellation via e-mail “for security reasons”. Cellular Choices denies any wrongdoing stating that, “We are just the carrier, you have to talk to Liberty Wireless. In fact, Cellular Choices is not a “carrier”, but fashions its web site to make it appear that they are a reseller of your services. I am taking this situation to the Attorney Generals of both Delaware and California. Unfortunately, in such a filing I must use the names of all the parties involved including yours. I will be most pleased to supply your legal departments with all of the e-mail paper trails that I have to show how this scam works, which you may use to exonerate your company. I hope that upon review of the information, you would take action to prevent these companies from using your name in the future.
