I tried a no risk free trial membership offer from ediets. During the first week they sent me an email asking that I join. I followed the link, and found that the shortest membership was for a three month period. I decided Id give it a try for a few more weeks. As the second month of the membership rolled around I received another email asking me to renew my membership. They advertised different levels, gold etc. and the last option was to not renew. I selected the No thank you option of the form. I had not visited the site and so no reason to pay for a service that would not be used. Ediets.com has been charging me for this cancelled membership since 2003. I was told on the phone today that they do not have a No risk trial offer, and that no such thing exists. I was also told that they did not send emails asking for renewal of membership. When asked if I had logged into the site, the first representative acknowledged that I had not. Then she changed the story to say that it is an online site and they have no way to tell if someone visits or not. When I advised her that this was not correct, she then changed the story to be that the site is there and available for me to visit if I should choose to, so it did not matter that I had not been there since 2003. I have not been to the website since the visit within the first 90 days of membership in 2003, when I followed the directions on the page to cancel (or in their words NOT renew). The representative told me that the terms of my membership were to automatically renew unless I called and cancelled. That I could not cancel at the website, and that they do not send out emails soliciting members to renew. She repeatedly accused me of lying and insisted if I cancelled I would have to give her the name of the representative whom I cancelled with, because it is not possible to cancel online. I asked the representatives for a copy of the membership terms that they were citing, and they were unable to do so. I asked them when I authorized them to charge my card, and they indicated that the online form that I filled out in 2003 (the one with the no risk trial that they insist does not exist) gave them a blanket authorization to charge my card indefinitely. I have saved a screen shot of the webpage that offers the No Risk Trial that they say does not exist. I should not be fighting over a membership that they acknowledge has not been accessed since 2003. This is their business, they solicited me, and sent an email that directed me to renew OR cancel the membership, no services have been provided which supports my statement that I did in fact opt NOT to renew at their website, I do not believe that the consumer should be reasonably expected to believe that this was not sufficient to consider the account NOT renewed. I agree that I should owe the first payment for the original 3 months, on the no risk trial. I did not cancel within the first 2 weeks, but I definitely opted NOT to renew. They were given notice within 45 days of my first contact with this business with my intent NOT to renew. Each charge on my credit card since that time is unauthorized.
