BACKGROUND I purchased an Apple iPod from Etronics.com. I received the iPod but it never worked. I tried to return it but they refused to accept the product saying that I should contact apple directly.
MY ARGUMENT My agreement was to purchase a brand new product (ie iPod) from Etronics. Etronics sent me a defective product, if not used. I had to send the defective iPod to Apple (as Etronics would not accept the return) who in return sent me a refurbished replacement. My agreement was to purchse a new product NOT a refurbished product which is what I ended up getting from Apple and Etronics.
Etronics' argument was that they supposedly said on their website that iPods are not returnable and they provided a screenshot of their website to that affect (after I complained to American Express about the defective product). Websites can be changed/altered.
NOTHING on the invoice that I received, and which I provided to Etronics and American Express stated that iPods are not returnable. The invoice is the final document that states terms and conditions and governs the purchase agreement. Legal cites need to be referenced on the purchase documentation i.e. the purchase invoice. Again, there was no reference. On the contrary, the documentation I have (and provided) states that there is a 30 day satisfaction guarantee from the ship date, as they say on their website.
The only real tangible documentation I have is the invoice and nothing on the invoice states that I could not return this item. My argument is that purchase invoices are legal documents. I want to have Etronics honor their commitment to ship to me what I purchased which was a new working product. Not a used, defectie or refurbished product. I want my $296.98 back.
