In June of 2004 we contacted ABN Amro to pay off our Mortgage and re-finance with a local bank. We were given the payoff and instructions of where to send certified bank check. We sent the check by FEDEX and proceeded to re-finance locally. Our loan went through and all was well, or so we thought.
On December the 6th 2004 we received notification from an attorneys office that our mortgage was in default and they had initiated foreclosure proceedings. We contacted our bank, and they checked and the check had not been presented for payment 6 months later.
In addition to this the amount they now said we owed was $5,000 more than in June. I provided then with proof that the check had been received in June. They instructed us to send another check, as they had no idea what happened to the first one.
We have done so, and they indicate it has been received and that loan is now showing paid in full. How can they foreclose on someone who tried to pay them off, after 6 months with now contact?
