With regards to the above referenced complaint, we would like to post the

following for placement:

Paybyweb is a Registered Independent Sales Organization (ISO) with NPC,

Columbus Bank and Trust. We have been in business since 1992.

The complainant conveniently left out his business name so that we could

reply specifically with regards to his account. Suffice it to say that

Paypal held his funds and my guess is that he has gone through several

processors by now.

In over 15 yrs, we have provided payment processing to companies like Olan

Mills, Jenny Craig, Investor's Business Daily, AAA Motor Club and thousands

of others. It is unfortunate to have a complaint, but obviously it is

impossible to please everyone, all the time.

PayByWeb

htttp://www.paybyweb.com. Supposedly handles credit card transactions but the owner is so confused, he's not sure himself. One time he is responsible for everything and the next time he's not. I sold an item on Ebay and, since PayPal is so screwed up, I looked for an alternative and this was the one I chose. PayPal had been holding my funds whenever a customer whined and, even though their investigation proved the complainer a fraud, I still had to jump through hoops. Guess what?

The first and only transaction I had through PayByWeb was held up because the customer input some wrong information. I cancelled immediately and it took a couple of weeks and finally, I told them to refund the money to the customer. I never got paid at all. My account was not set up until January 6th for which money had been taken from my bank account in December. Yesterday, January 28th, there was another $25.00 taken from my bank account by PayByWeb.

I emailed the IIC (Idiot In Charge) and he told me the payment was for January and admitted that I had cancelled the account on January 13th. I am now back to PayPal. I am a power seller on Ebay and cannot have my funds frozen. I also have StormPay which I am trying out. They have an interesting auction site where I have bought items and have had no problems with them at all.

Here is the info on PayByWeb:

Like the other person complained, I too was told I could no longer use paypal for our site. We tried another 3rd party processor and within months they told us the same thing even after I was told on the phone by them that my completely legal adult content was acceptable.

Rather than have to cancel hundreds of subscriptions a third time, I decided to get our own merchant account, and to be safe I would pay extra to have a HIGH RISK account so they would not have a problem with my xrated images.

I turned to PaybyWeb and agreed to pay the $200 processing fee upon acceptance. The site mentioned being up and running the next day in some cases. I think the keyword is 'some' because it has been a month now after attempting to open our High Risk Merchant Account through PayByWeb and the only response we've received so far is that the bank declined us because of our xrated images. If I backup a step the person who said that to me told me he was Marc from PivotalPayments and that he received our information from PayByWeb. It sounds like PayByWeb sells application information maybe??

After asking why the bank wants us to remove our xrated pictures after we had applied for a high risk account, we were told that the bank they put us through doesn't accept adult material!

At this point it's getting closer and closer to Christmas and several weeks after initially applying. I gave in and removed 11,000 pictures more than a week ago and after several days contacted Marc and he told me he hasn't heard anything yet but promised to let me know ASAP but that was more than a week ago.

At this point I don't know who has my personal information such as Social security number, checking/routing information, date of birth, etc. but I don't think, even after removing 11,000 pictures and redesigning the way our site works to disallow xrated material, that they will accept us because I would imagine we would've heard from them by now. I will have to check my statement to see if I was charged the $200 because one or two days after submitting the application I received a call saying Congratulations we were pre qualified or something like that. I wonder if that meant he was able to charge me the $200 only for me to still be trying to find out what the status is a month after my application. I will keep everyone posted on whether or not the final outcome is a good one or not.
