January 25, 2005 Re: Purchase of 2001 Mercedes S55 To Whom It May Concern: On November 29, 2002 I purchased a 2001 Mercedes S55 from Lineback Enterprises. I dealt with the owner Matt Lineback, who informed me that the car was a trade-in from a personal friend that he had already purchased another vehicle for. When I questioned its condition he told me that he had bought the car for his friend a year before and that it was well maintained and flawless. A year after I purchased the vehicle I called State Farm to get an insurance quote for a new policy, when the rep ran the VIN# he asked when I had wrecked the vehicle.

 

He then informed me that there was an $18,000 insurance claim on the vehicle. I tried to contact the owner since the damage was never disclosed to me. I spoke with the General Manager George and he informed me that only Mr. Lineback could handle my situation and he would pass on the message to call me back, I left five messages with George and never received a response. I have tried to call the Dealership eleven times and never even received a return call. I tried sending a certified letter and again received no response. I contacted an attorney and they sent Mr. Linback a letter and he still would not respond to me. The vehicle has had many problems that are a result of the damage done to the vehicle. Excessive tire wear has caused me to replace the tires 4 times at $1400.00 a set in 23,000 miles, the horn malfunctions which is a safety hazard, and excessive wind noise through the drivers side door jam. At the beginning of the year Mr. Linback finally contacted me for a 10 minute conversation where he informed me that it didn't matter if it was wrecked it still had the same value as an unwrecked car, which as an employee for a large automotive group I know to be false. During our conversation he was rude and overly aggressive threatining to break me financially and drag this all the way to the Supreme Court. At the end of the conversation he said he would call me back by the close of business with an offer to buy the car back, I am still waiting for his return call. Thank you, Thomas Lee
