mohawk laminate faulty installation

In may of 2004 I called a local store and asked about the laminate flooring. I was told it is a sealed wood, easy to clean, and guaranteed for 10 yrs.

The store sent someone out to measure the area and brought samples with him for me to choose from.

I ordered the laminate and paid 1500.00 down from my visa card.

within a week the floor started to buckle. the store sent one of the installers out to fix it. the guy was very annoyed and said the floor was to tight.

within another week or two the other side of the floor started to pull apart and a big upside down V about 3" off the floor ran the entire length of my living room.

I am a disabled senior citizen and walk with a cane. I was afraid I would fall and asked the store to please come out as soon as they could to fix it.

this time 2 installers came out and one of them said the entire floor needed to be redone and they didn't have the time to do it. they called the store and told the owner about the floor needing to be redone. the owner said they would contact mohawk and they would send an investigator out to see why the floor was coming apart.

the investigator came out and took a lot of pictures, spent a lot of time looking at the floor. when he left he told me that it would take about 3 weeks for mohaw to get back to the store.

A month later I called the store and asked if they got the report. one of the employee's said yes, the report was sent and the owner was not satified with the report and reqested a 2nd opinion. he said the owner would call me. He never did. I put a call into my visa card and they took my down payment of 1500.00 out of the stores account.

The owner still would not call me or fix my floor.

I reported him to the BBB and he did answer their complaint. not right away but after a few letters from the BBB he answered.

first he said I had 6 dogs urinating on the floor. and then he went on to say that when the installers came out they had to clean feces and unrine off the floor that was installed the day before.

I was either in the kitchen or watching them install the flooring.

they never cleaned up urine or feces.

I had carpet and it was to hard to clean so I wanted something that was easy to clean. the installers were paid to take up the carpet and get rid of it.

The store owner said the installers did a lot of things for nothing to satisfy me. the only thing they did was unplug my computer and the tv and I paid them extra for that. Nothing was free.

I took the owner of the store to small claims court and he brought one of the installers with him.

I won the judgement and one day short of the 30 day appeal time the store owner hired an attorney to appeal the decision.

I am at my wits end. I am on a limited income and do have money to have this floor taken up and another one put down.

Not one time did the store owner say that maybe another floor would be better for me and offer to do something.

I have photos of the horrible floor

anyhelp you can give me will greatly appreciated.

now I have more expense. I have to hire an attorney.
