Smart Cars of Lexington will not return my down payment

I attempted to purchase a 1996 Cadillac STS from Smart Cars of lexington sc. Jason, the finance manager, could not get me financed. He has refused to return my down payment, which he cashed before he even knew if the deal would go through.

I was told by my sales person that Jason said the down payment was forfeit. These people are not to be trusted in my opinion.
