Attn: Tamy Roberts, CSR Re: Requesting refund of $420.00 I am writing to inform you of a problem I am having with one of your agents in Los Angeles and to request your assistance in resolving the issue.

The referenced agent’s address is 10800 W. Pico Blvd, Suite 293, Los Angeles CA 90064. The center is located at the Westside Pavilion mall in Los Angeles. The center is managed by Maryan Thomas. At Westside Pavillion center, I signed up for a series of four laser hair removal treatment procedures. I prepaid for these procedures in two payments – one payment of $60.00 and a second for $180.00. Each treatment was worth $60.00. When I signed up for these procedures, I was not informed that because of my black complexion, laser treatment would likely burn my skin unless I lightened my complexion first. I underwent the first procedure with no side effects. Upon coming in for the second procedure, I was informed by the technician that I may need to lighten my complexion in the future in order to undergo laser hair treatment. The technician, (Paula Abrahimi) did a test of the treatment on my skin and determined that my unlightened skin could handle the treatment. She performed the procedure on me.

 

Ms. Abrahimi was the first to mention to me of the necessity for lightening my complexion before undergoing the treatment. Before I left the center that day, I inquired about signing up for a microdermabrasion procedure. I agreed to sign up for one procedure. I was encouraged by the clerk at the front desk and another technician standing nearby to sign up for a package of 6 treatments, to include chemical peels as well as microdermabrasions. According to the technician, it was better to clear the slight acne on my skin before undergoing microdermabrasion. They told me the package of 6 would be a better and cheaper deal for me. The cost of the package was $300.00. Indeed, the clerk went on to inform me that if I did not like the first procedure, I could cancel the other procedures.

 

The next day, I discovered some serious burns on my chin area from the laser hair removal treatment. I came in to the center and was examined by Ms. Abrahimi who assured me the burns would heal. I did some research online and discovered that if the laser machine is properly tuned to one’s complexion, burns do not occur. I since decided that I did not want to subject myself to the possibility of misapplication or machines or chemicals on my skin and contacted the center to ask for a cancellation and a refund of my money that I had prepaid for all the services I was expecting. As per the laser treatment, I was unwilling to lighten my complexion in order to continue the treatment. I was informed that the company does not issue refunds as I had signed a consent form before undergoing the laser treatment.

 

I did sign consent forms for the laser treatment. However, when I signed those forms and paid in full for the expected services, I was not fully informed of the risks I would be exposed to. I signed the consent form in good faith upon the expectation that I had been informed all material facts I needed to know in order to safely under the laser procedure and upon the expectation that laser machine would be properly applied to my skin. I was not informed that I was to lighten my skin in order to reduce the possibility of skin burning- had I been informed that I would need to lighten my skin, I would never have signed up and prepaid for the procedure.

 

To now hold that a consent form that I signed based on misinformation (because the omission to inform me about the importance of skin lightening is material) is highly unprofessional and borders on fraud. The professionals had an obligation to inform me fully of the steps I would need to take in order to receive laser treatment, particularly since your company requires customers to prepay for services for which they cannot get refunds. Given Nuvo’s very unusual and suspicious payment and refund policies, your professionals are obliged, at the least, to fully inform customers of what it is they are signing up for. I am also requesting a refund for the $300.00 I have prepaid for the chemical peels and laser treatments I will not be receiving. First, I signed no consent agreements informing me of a no refund policy with respect to this package. The consent agreement from that laser hair treatment cannot be applicable to the chemical peel procedure because it is void for the reasons explained earlier. Second, I was induced to sign up for the package when it was not originally what I intended and was informed by an employee of your company, speaking on behalf of your company, that I would be able to cancel the treatments if I did not want them. Your employee informed me that I could cancel, and since your employee represents Nuvo in dealing with customers, your employee is an agent and has bound Nuvo to what he promised me.

I came to your center for cosmetic help. I was misinformed, physically injured, and induced to sign up for procedures on which I cannot get a refund. In short, I was taken advantage of. EKPEBE
