Car threw a rod at 50,000 miles. Car has been perfectly serviced since new (one owner) at Underriner Volvo in Billings, Montana. Engine was full of oil when it blew up. Car is eight months out of warranty. Volvo has only agreed to pay for 25% of fixing the $9,000 cost to fix the engine.

This is completely unacceptable. The defense that the warranty expired is ridiculous. It is a contract of adhesion, assuming a contract existed, and therefore unenforceable.

Also, the car has clearly failed the implied warranty of merchantability. Underriner Volvo identified a serious oil pressure problem with the car a few months ago, that is, no oil pressure at all, and failed to remedy the problem.

The days of a car throwing a rod I thought ended back in the 80's. Assuming Volvo does not agree to pay to fix car, litigation will likely ensue. Cost in attorney's fees to Volvo could very well hit $50,000 without going to trial, regardless of who wins or loses. Great car, except for the engine.
