In 2005 Anna Asked D-Best Kitchens, Inc to give her an estimate for cabinets and tops.

D-Best Kitchens did produce a design. Anna did approve that.

D-Best Kitchens Did builds all the cabinets and the tops in the shop. Anna approved all production, Sizes, Color and design.


The job was a quality job. Anna wanted to pay with several payments and D-Best did agreed to that.


D-Best Kitchens is committed to deliver a quality design, and workmanship.

We are committed to build superior cabinets.

All cabinets being build in a superior quality, including Anna�¢??s Kitchen.


We believe that D-Best Kitchens performed all what promised according to the contract.

And we hope that Anna is enjoying her kitchen for the last several years.

To Whom It May Concern:

 

Back in January 2005. I have hired a company named D-Best Kitchens, Inc. of 246 E. 131 St., Cleveland, Ohio 44108, to install new cabinets and countertop in my kitchen. The owner told me that his cabinets are "custom", showed me examples of the door finishes, told me that he does a good work and put me on the monthly payments schedule. Afterwards, the nightmare ensued. One day his contractor came to remove a row of my old cabinets. He sat them down on the floor and left, saying that he didn't have a truck.

 

He showed up again several days later, this time with the truck, and attempted to drag the cabinets across the room and out the front door. I asked him to go out back but he refused, saying that his truck is parked out front. As I didn't want my property damaged, I had to help him carry the thing, which was heavy. That was only the beginning.

 

The company owner, Mr. David Pessar, has refused to do certain things up to my specifications, while still claiming his cabinets to be "custom". While installing cabinets, his contractor completely ignored the fact that my walls weren't straight, this is called "out of plumb", as I'd learned later online. He didn't use any shimmy or support. They also used drywall screws, despite my asking them to use cabinet screws with washers. The screws they use, some of them are on the different levels and/or angles, within the same cabinet.

 

They look as if I'd put them in by myself. The end panels aren't nice and smooth. Rather than buying pre-finished panels that are done on the special machine like the ones in Home Depot, Mr. Pessar bought the ones that were unfinished and attempted to finish them manually. But this isn't the same. A row of cabinets where a built-in microwave oven is now installed, aren't flush with it. I specifically asked Mr. Pessar to make sure the cabinets will be flush with the microwave oven, and was assured that this was no problem. Well, it isn't so. Besides, a row of cabinets came within one inch gap from the soffit wall, which means that he didn't take the right measurements. It looks rather odd.

 

Now about the countertop. It is formica laminate. I wanted it to have round edges. Mr. Pessar has flatly refused to do so, saying it was impossible. I later on found out this was possible at the places like Home Depot, and that it is called pre-formed laminate kitchen counter, the type with the backsplash already attached and round, just like I wanted it to be. I told Mr. Pessar that I didn't like it. I don't know whether he will re-do it. The contract provides for Satisfaction Guaranteed but unfortunately, does not specify what to do if the satisfaction isn't achieved. Mr. Pessar's contractor couldn't even cut an opening for the sink in the countertop correctly. This will have to get re-done by another company at my expense. They say he didn't even use the right tool.

 

Even though Mr. Pessar has initially signed me up for the monthly payments, he kept on pressing for more money. As of now, I advanced him $4,500 by a credit card, and he still wants more. The total price is $9,000. By the way, what I paid him, is more than I owe him according to the contract. It exceeds the amount I owe him as of today, by $1500. We are talking about approx. 12 linear feet of cabinets plus a utility cabinet. They look anything but custom. What kind of custom cabinets are they, if he couldn't do what I wanted to be done, and I wasn't unreasonable. By the way, the cabinets installation still isn't finished.

 

What is missing, is the doors and drawer fronts.And shelves. And the hardware, of course. I wonder whether there is a reason why Mr. Pessar keeps on insisting on more money before the doors and drawer fronts are in. I am concerned that because of the walls being "out of plumb", the doors might not fit right. I want everything to be re-done the way I wanted them to be, but apparently, Mr. Pessar isn't happy about it and is not particularly in the hurry to correct it. He is only in the hurry for more money. This monthly payment schedule was his selling point. If not for that, I would have never hired him, I told him that a few times already.

 

Bottom line: I am not satisfied with the work D-Best Kitchens did. I want to terminate the contract and hire another, more competent, company, to undo the wrong and do it right, and to finish. I think the company advertisement is misleading. The cabinets are anything but custom. The problem is, I am under obligation to pay the total amount. This lasts a couple of months already. His contractors sometimes don't show up. My place is a mess. I don't have either water or a stove connected, and cannot enjoy my new kitchen. One more thing: Mr. Pessar has never advised me that I needed a permit to do my kitchen remodeling, and I didn't know. Now I accidentally found out. I am afraid to get in trouble for not pulling a permit. How could I know, I am not a cabinet maker. In fact, most companies would pull a permit, that is what I was told.

 

Thank you for the time that you spent reviewing my complaint. I do appreciate if this helps to resolve my situation. Granted, I didn't do enough "homework" before hiring this company, but there is no reason for them to take advantage of me.
