The business is called Enhanced Recovery Corporation. It is located in Jacksonville, FL at 10550 Deerwood Park Blvd. Suite 600. The company's phone number is 800617-0049.

 

Two years ago, I bought some clothes via Newport News Catalog about $100. I even sent some back that were never credited to my account. At some point, they filed bankruptcy when I had an outstanding balance. Although I did make a payment, it seems that wires got crossed. This is the first example of how the company files for bankruptcy and the little guy gets screwed. I did this over the phone which BUYER BEWARE---insist on the good old fashioned paper check that actually gets cashed (I.e. not electronically).

 

Unbeknownst to me, apparently, a small balance remained that kept accruing late charges. In July 2004, I was contacted by Adam Silk at Enhanced Recovery Corporation. I explained that I had not bought $355 of clothing, but this was my new balanced. Reluctantly, we reached a settlement agreement of 60% of the balance. These people have your credit and their future in your hands, so it seemed like the quickest and easiest way to settle this. Furthermore, this 213.04 could be paid over three months. September 1, October 1, November 1. I asked for him to send this in writing.

 

On August 10, 2004, I received a letter dated August 5 (it had been two weeks since I had talked to Adam at ERC). The letter stated that the payment must be received by August 10th.

 

I called ERC and spoke to Jesus. He agreed that wires got crossed. According to him, the agreement was still good---original terms and all. I guess I should have gotten this in writing, but live and learn.

 

On August 30, I made a phone payment of 75 to Jesus. I was told that I should have a receipt in 7-10 business days. No receipt by the 15th of September, so I called. I spoke to Bill who told me that my check had bounced. Not true, after further conversation with him, he told me that it looked like someone had made a mistake and confused the routing with checking account number. Finally, I have learned. Don't pay anything over the phone! All I needed to do was to send the payment promptly and the original agreement would be valid.

 

On September 16, I placed a check in the US mail for 150 (September and October's payment). The check was cashed by ERC on September 23. On October 1, I received a letter from ERC stating that my check had bounced. Again, not true.

 

On October 4, I faxed my documentation, along with the copy of the cancelled check. After work, on October 4, I called and spoke to the collections manager, Ryan Laberinto. After being treated rudely, he told me (the first one to do so) that the original settlement was not valid because I hadn't paid by August 10.

 

At no time did anyone tell me this, nor is it in writing. Not to mention the fact that ERC hadn't sent the mail in a timely fashion. ERC set me up to fail. After a frustrating phone call which I have on tape, Ryan said that he would settle for 70%. How is this fair I asked, what have I done wrong? He passed me off to Josh who said that he would fax it on October 5th by 9 a.m.

 

Guess what, no fax. I called and spoke to Josh. He assured me that I would have it by 3:30. Guess what, no fax! Does anyone notice a trend in how this company does business? I have left messages. I have asked to be transferred and I am mysteriously disconnected.

 

How does one get this resolved? Every time that I send a payment, there is some sort of mistake that they say is going to cost me. What rights do I have? I am just the little guy that is being trounced upon by a company that at the very kindest, has sloppy business habits.
