My complaint is in regards to Intermountain Funding LLC

Richard Dover (President & Sr. Loan Officer) Nov '03 Contacted Richard for refinance Nov '03 Towards the end of November Richard came by our house to go over the

paperwork. We signed some papers authorizing him run the credit check, also we wrote a check for 460+ dollars as a good faith money in the case we cancel our application. Dec '03 I've placed about 5-6 calls during this time frame and we never got

a call back. I was only able to speak with Richard when he was picking up the phone. Dec '03 We went to the title company. Signed the papers but I found out

what the interest rate was during the paperwork. In addition I was supposed to bring up 900+ dollars for the closing which was not disclosed to me. We rushed to the Title office the day before Christmas to close. Dec '03 Next business day after Christmas, I went to the Title company and

cancelled the refinance paperwork within the given grace period. Jan '04 I've received a letter from Intermountain stating that I owed the

1380+ dollars for cancelling the refinance. Also, one of the papers

1380+ that we

signed was photosopied and attached that showed a page with the 460+ dollar we agreed in addition to the 900+ penalty fee which was on the upper part of the paperwork that Richard never disclosed to us. During our first meeting he pointed out the 460+ dollars which was at the lower section of the paper, therefore hiding the 900+ that was on the same paper. At the same letter he mentioned that if we decide to refinance within 6 months the penalty fee would count towards the closing costs. Jan '04 I contacted Intermountain Funding and talked to Richard stating that we were looking to buy a house and we would use him to purchase our house. He stated that it would be OK Apr '04 We found a house to purchase and contacted Intermountain and talked to Richard. I gave him the price of the house we were looking to buy and thinking of financing the whole amount. Apr '04 Towards the end of April we closed on the house. During the month of April I called Richard several times and my calls were never returned. I didn't know the interest rate once again until we went to the Title Company and found out that it would be 8+ percent. My average credit score was 733 at the time of the closing. Right after we signed the papers, as I was walking out the door Richard stopped me and asked me to pay for the appraisal that he ordered during our refinancing. I told him to call me the following day so that we can discuss it. Apr '04 Our real estate agent called Richard and told him that he got us an unreasonble rate and this was not good service. Richard stated that he will send us a letter stating that if we decide to refinance Intermountain will pay all of our early penalty fees if we go with them, or half of the cost if we decide to go with another company. After our real estate agent asked about the appraisal fee for the refinancing, he stated that since we closed the new loan with them we do not have to pay it. May '04 We have received the letter signed by Richard (president and sr. loan officer) and Cory (the owner) stating that they will pay our early penalty fees. Aug '04 We have decided to refinance our house since I was qualified for 4.125% loan. First Greensboro called Richard and he stated that their intent for the letter was after 12 months. Then I contacted Richard and told him that the letter stated within 36 months without any time restriction. He said that he will call Cory the owner since it is his company and would get back to me. I didn't get a phone call the next day and I called Richard again. He told me that he couldn't get hold on Cory but he would call me as soon as he can. The following day he called me and told me that they will pay their half, but they can't pay until between September 15-20. I told him to check with Cory and let me know if they can pay on August 21st as I will be closing the refinancing on that day. he said that he would call back but never received any calls from him. Sep '04 I called Richard in the beginning of September and told him to not

to mail the check and I would come by on the 15th to pick it up. He said it would be OK Sep 15, 2004 I called Richard but Dell in the office picked up the phone and

told me that he was on vacation and he didn't know when he would be back but probabl on Monday (9/20). I went by the office and gave a copy of the closing statement that showed the early penalty fees and how much they had to pay. I asked Dell to find out when will Richard be back and call me. Sep 15, 2004 I contacted Greensboro to find out if Intermountain Funding

contacted them to receive the closing paperwork to find out about the penalty fees and Intermountain did not contact them. Sep 20, 2004 I called Richard and Dell answered the phone again and told me

that Richard will not be back until the end of September. I asked for Cory's (the owner) phone number. I called Cory and left a message asking him to call me back. Sep 21, 2004 I called Cory again and left another message around 10am in the

morning. He did not return my call. Sep 22, 2004 I called Cory and left a message stating that if I do not get

my check by Friday (9/24) I will proceed with legal action and my lawyer will contact them. I also called Intermountain and talked to Dell and told him to pass my message to Cory and Richard that I will proceed with legal action on Monday. Sep 29, 2004 I met with Brian Lofgren - my lawyer. We went over the

paperwork and details. Brian will send a notice to Intermountain Funding via e-mail, fax and certified mail. Oct 2, 2004 I received the first draft of the letter and approved to be sent

to Intermountain Funding. Oct 11, 2004. I filed a complaint with Better Business Bureau. Oct 12, 2004 I received a confirmation mail from BBB with the case number 22006706 Nov 5, 2004. I was contacted by my lawyer stating that his letter, fax and phone calls were not returned and no answer from the company has been received. I signed the papers to take Intermountain Funding to the court. Nov 6, 2004. I received an e-mail from the Better Business Bureau stating that they have attempted to contact the business twice and they did not receive any response from the company.
