This is the third e-mail we have sent regarding the tomato plants we have paid for and only got dirt! Please advise as to when you plan to replace these plants or to refund us for the money we paid. We are most distressed that you have elected to disregard our request for either replacement or a refund as your add for these plants indicates.

Sent: Sunday, May 16, 2004 1:24 PM Subject: Tomato Tree Plants On 8 MAY 04, I sent the following, but have NOT received a response yet. Please advise as to when you will replace these plants. There is NOT even a start of anything in either pot.
---------------------------------------------------------- Sent 8 MAY 04: My husband ordered two tomato tree plans and carefully followed the directions. Neither pot produced even a stem and root. Please either send two viable replacement plants or return our money and postage. Right now, we have two peat pots with a bit of dirt and nothing inside the dirt or pot beyond the dirt that was placed there to begin with.
Thank you for taking immediate action to rectify this issue.
