In response to the complaint brought by Mrs. Mianti, it is not quite as simple as she states. Although it is the responsibility of the homeowner to obtain a building permit, as a courtesy, we will file the paperwork. The permit applications were filed along with the necessary drawings stamped by an architect to the Village of Croton on Hudson. We were subsequently informed that since there was a brook/stream nearby a wetlands permit was necessary and it would have to be submitted to the board which met monthly. Since there was a meeting coming up, Mrs. Mianti said she would go submit and pay for the wetlands application while I tried to compile the additional information requested. The meeting was then postponed due to the absence of board members and rescheduled for a later date. In the meantime, the town made a number of additional requests for information. I responded to each of their requests which seemed to change each time. It should be noted that the Miantis did not want to incur the additional expense of having a surveyor do a topographical drawing of their property. Their property was fairly level and when discussing it with the inspector, he didnt think it was necessary and then the next request would ask for it. The town couldnt say for sure if it was required or not, they kept changing their minds. We did go out to and shoot some grades to give them an idea of the grade of the property but unfortunately, the person who was supposed to go to the meeting became ill and never made it there. The Miantis did not go to the meeting either. At that point, Mr. Mianti said he did not want to go through the bullshit with the town and asked if I would agree to cancel the contract. Although we had every intention of fulfilling our end of the contract, we could not do anything without a building permit. Since I had spent numerous hours already dealing with the town and not getting very far, I agreed to cancel and refund their deposit less the expenses incurred. A check was sent to them and as far as I was concerned this issue was resolved. The spring is an extremely hectic time in this business, I was not dodging calls but extremely busy and working at least fourteen hours a day. Sometimes it is just too late in the evening to be returning calls. Had it been Mrs. Mianti spending all the time making the numerous phone calls and writing letters, I think she would not have considered that NOTHING was done. This experience has taught me not to be so nice, just to provide the information needed and to leave the responsibility of the permit in the hands of the homeowner. Ellen C. Leone Epic Pool Corp. On, February 7, 2004, we signed a contract with Epic Pools for the purchase of a Sterling Mountain Lake 24'X44' pool to include parts and installation. The total was $35,349.00. With the contract, we included a 15% downpayment of $5,302.25. Epic was to have filed the necessary applications with our Village to obtain clearance for the contracution of the pool. In early March, we were told by the Village clerk that the building permit application was filed, but that the necessary accompanying plans were not. We contacted Epic and were assured that they were 'on it'. (We learned on 5/17/04 that a $207 check from Epic to the Village bounced and Epic did not replace it.) We learned that, in addition to the building permit, we needed to apply for a Wetlands/Watercourse permit. Because we could not get Epic to file the permit in time for the once-a-month board meeting to have been held on 5/5/04, I personally brought a check in the amount of $125 to the Village clerk. Epic, again, did not forward the necessary plans nor did they show up for the meeting as Ellen (of Epic) said they would. We then have to wait for the June meeting. As of today, 5/17/04, Epic has not submitted any plans. However, we were billed an additional $465 for the application fees they said they filed. At this point, due to their negligence and procrastination, we have missed out on the swimming season as board meetings are so spaced out. On May 10, we requested our money back as they were not planning on completing their end of the contract. Ellen said that it was fine, they would send us our money, less their expenses. It is 5/17/04 and Ellen & Epic are dodging our calls. They have our money for which they did NOTHING. Monica M
