I have had it with this mortgage company and filing a complaint with HUD. My payments for my escrow were applied to monthly payments making me 4 months ahead with my escrow running in the red.
March of 2003 I contact my attorney and explained the situation to him and I repeatedly tried to get the company to put the payments in the escrow account, plus they were electronically withdrawing my mortgage payments out of my bank account. I finally received a letter saiding they were sorry that I was not contacted about the policy changed. That only happened because of my attorney letter.
Now a year later I have one years worth of taxes and insurance in the escrow account, which under Section 6 of RESPA they can only hold 2 months and 1/6 of the total escrow as a cushion. I have requested repeatedly for the overage to be sent back to me and get no response. I also had switched homeowners insurance which cause me to have 1,000.00 credit per year in the escrow to make up for the shortage 3 years ago.
Then as I get my 1098 form for taxes it shows on of my payment was added to a late charge. That too is illegal, so that means I am one month behind. They would send me letters saiding I had no homeowners insurance on the home, when in fact they paid the new policy and that took me 6 months of getting that straighten out. This company needs to be taken out of business as they are taking peoples money.
