Victoria's Secret (online catalogue)

In Feb. 2004 I received a promotion from Victoriasecret.com rewarding $75 off of purchases $200 or more. I proceeded to order approximately $250 worth of items from their website. When I received the order in the mail, the receipt indicated that 5 of the items would not be available until April and May and that a special offer amount of $75 had been deducted from the order total I paid $85.22 on my MasterCard and another $44.70 charge was pending when the other items were released from backorder.

The shipment I received included one bikini top, one bikini bottom and one pair of pajamas, 3 out of 8 items ordered. The bikini top and bottom I paid $38 and $28 respectively. They did not fit properly and I returned everything according to procedure and in perfect original saleable condition.

I decided that I did not want to wait 3 months for the rest of the order so I cancelled the backordered items. On March 26th I was issued a refund of $6.85. I called Victoria's Secret customer service to inquire about this incorrect refund amount, and they explained to me that because I used the promotion and proceeded to cancel the items I that had been on backorder, I was required to PAY the $75 promotion amount that was initially taken out of the order total.

So in essence I had to pay a $75 punishment fee for items sold on their website but unavailable in their inventory. The customer service agent proceeded to inform me that if I had ALSO returned the pair of pajamas that I purchased and kept for $35, in addition to the bikini (which means I would theoretically have returned all the items I received), I would only be refunded around $5 which would mean I paid $75 for nothing+S&H which I understand is not refundable. My complaint is that Victoria's Secret Catalogue charges you for the promotional amount of $75...as penalty if their items are unsatisfactory or unavailable to you. I am disputing that I should receive a refund of $66+tax.
