Cingular Wireless Non-Refundable Activation Fee
This is a copy of the complaint I sent via email to the FCC:
I wish to file a general complaint against Cingular Wireless, located on 3749 Sports Arena Blvd, San Diego, CA, 92110, phone number 619-299-4455, sales representative's name is Roman. On May 29, 2004 I went to Cingular to activate service on my cell phone. The make is Siemens, model SL55 and is a GSM type phone. I needed web access and a calling plan.
Roman sold me a plan and gave me a SIM card which he placed into my phone. I was given the phone number 619-400-9933. He told me I would have register through Cingular's website in order to activate web access. I would be able to make and receive calls in the meantime. When I got home I registered with mywirelesswindow.com.
But I was not able to obtain web access. I phoned Cingular's technical support and their rep. informed me I would have to input settings into my phone which I could obtain through their website. I went onto their website again and input the information. I still did not have web access. The day after I went back to the Cingular store and was told that I would have to go to another store that had a technican on site.
I went to Cingular on 5638 Mission Center Rd, Suite 103, San Diego, CA, 92108, phone 619-209-5869. The technician told me the phone was not compatible with their system and I would not be able to obtain web access through Cingular. He said he could sell me another phone. I told him I did not want another phone and I asked him to terminate service. He terminated service and said I would still have to pay the activation fee of $39.99. I said the salesperson Roman misinformed me by telling me I could obtain web access with my phone.
I relied on Roman to give me the correct information and based on his professional advice, I agreed to have Cingular as my wireless provider. The technician said it didnt matter. I still had to pay the activation fee. I called Cingular's Customer Service (800-331-0500) and was told that it didn't matter what the salesperson said. I signed a service agreement. I told her this means a salesperson for Cingular has no duty or obligation to tell the truth when making a sale. This is highly unethical and I would file a complaint with the FCC and the Better Business Bureau.
