Washington Mutual Home Loans Well I am having problems with Washington mutual and I am sure that there are a lot of people out there with the same or similar problems. I originally purchased my home in June 1997 from PNC mortgage; they were later bought out by Washington mutual. When I originally set this up I made direct payments though my checking account. 2 weeks after my mortgage was bought I was informed that I was a month behind, I ask how since I paid directly from my checking account. Well they asked for all my documentation and after 3 months I was informed that even though I made payments on time that the account number I was making payments to did not state that they were going directly to Washington mutual. After another year of phone calls and letters they finally agreed that the payments were made and my account was paid up to date. Last year I get a notice that I am now two months behind in my payments. Currently I am finalizing my chapter 7 bankruptcy. After trying to get information from WAMU from day one notice till Jan 2004, I have tried there homeowners assistance, got nowhere, several times finally when I get a response I am told I should go thought with there pre foreclosure process, this is 7 days after I receive a notice from the sheriff office of the foreclosure court proceedings filed by WAMU. This is now June of 2004 and I and the bankruptcy court has sent them letters of the meeting of creditors so far nothing, no comment, after I filed my bankruptcy WAMU they then filed a stay, so that they could proceeded with the foreclosure. As WAMU put it since I did not have the funds to pay them off completely prior to the bankruptcy they do not want to be held for the full amount to pay out by them for the bankruptcy. Now listen to this when I bought my home 7 years ago my mortgage payment was $785.00 a month with an escrow account to pay for my home insurance and property taxes. After WAMU purchased PNC mortgage my mortgage has risen to $1025 a month and every month since they bought it I had to pay more and more into my escrow account. Currently after all the extras that WAMU has put onto my account I now owe more than when I first purchased my home (125,000) after 7 years of making payments I now owe over $129,000 on it. When I found out that WAMU was going to foreclose on my home I went to a lawyer after she had looked over my records and that which WAMU sent us she said she could file for a complete disclosure of all there charges, but of all the cases she has seen concerning WAMU she said she would doubt that I could save my home at all even with my canceled checks and all the documents showing payments were made by direct payment. She stated that I do not have the funds to battle WAMU in court. That eventually they would win. I went to two other lawyers in this area and got the same response. I truly believe that WAMU is so big that they really dont care, after checking with several state and government agencies I have seen that since 1997 WAMU has done this sort of thing to several people, both in personal accounts and in home mortgage accounts, losing payments/deposits and when you try to question there practices you get the runaround. I cant tell you how many times I have called WAMU customer service and as soon as I get a person I suddenly get disconnected, and any time I pushed to try and talk to someone I get notices and collection callers calling me from 7am in the morning to 12 midnight, one collection caller who called me at 11pm told me that it was only 6pm her time so she was well within her rights to call me, this was after 50 calls after 9pm all from WAMU collections department, I told her that again that since I have young children living in my home that if WAMU can not call me during regular business hours or prior to 7pm m-f I will consider what they are doing as harassment, so it goes without saying soon afterwards they filed for foreclosure. All this while I was trying to get more information as to when the two payments were supposed to have not been made. So now WAMU is trying to get my house sold at sheriff sale prior to my bankruptcy and hoping to get me for as much as they can, one lawyer I talked to stated that I can believe that WAMU will probably buy the house as cheaply as possible and then charge me as much as they can in fees so if I wanted a more fair sale I better file for a chapter 7 bankruptcy. That way they have to show in writing all of there fees and a full disclosure of them prior to the final ruling 30 days after the conclusion of the meeting of creditors. Now I am not rich after I was laid off again for the 3rd time in 3 years I have only my disability income to live on. I can not afford a lawyer for anything but I make $6.25 a week to much to receive any legal aid. I make $2525 a month in my disability I have a wife and 4 kids and I make too much. Thats a laugh. So I am filing my bankruptcy without a lawyer. You would not believe what the WAMU lawyers are trying to pull over on me, luckily federal bankruptcy court assigns a lawyer to act as a trustee to make sure that no one (debtor or creditor) tries to pull a fast one. As far as my research has taken me on all of WAMU business practices, for anyone unable to refinance there home (WAMU reported my delinquency 6 months prior to informing me of it and refused to provide an accurate accounting so I could refinance to any bank or reputable mortgage company) and do not have the money to take them to court, you are better off filing for bankruptcy.
