I am currently in a dispute with Bally Total Fitness, regarding what I believe to be breech of contract on their end! Im trying to be refunded $2,426.00 for personal training that I will not be using, nor do I want to at this point after how Ive been treated! I have been a member of Bally Total Fitness for 4 years and was a great customer of theirs, I had decided to buy 24 personal training session and was given a very knowledgeable qualified personal trainer, we finished our 24 sessions, and I liked him so much that I purchased an additional 48 sessions, before I had a chance to use them the personal trainer that I liked was promoted and moved to a different location.
Ballys had switched me to another personal trainer who in my opinion was not as qualified and it was a real pain trying to get an appointment and when I would call and leave a message for him to get back to me, he wouldnt. I tried complaining to his manager, who also would not return my phone calls! I tried call there corporate office with very poor customer service and they wouldnt do anything for me either!
Then my first payment came out of my account, it was $300.00 more than it should have been, it put my checking account into overdraft an additional $300.00! When this occurred I went to the personal training manager at my Ballys. Hes a very good sales person and convinced me he would get it fixed.
I also called their corporate office to file a complaint; the person I spoke with informed me that my Ballys should have sent an amendment to my contract to them, which they did not do! I was assured by the women I spoke with that if I got a letter from my bank stating that their error had put my account into overdraft that they would refund the fees. I got the letter gave it to the personal training manager at my Ballys and he sent it to the corporate office. 3 months later no response, no refund and response from my Ballys or the corporate office regarding my refund of overdraft fees.
I finally got a message from the corporate office asking for my bank statements from 4 months ago! I tried to call back and tell them my bank statements wont show that you put my account into overdraft, because I had enough money in my account for their over charge to go through. Technically a check I had written to someone else put it into overdraft, but had they not taken $300.00 to much, all of my checks would have cleared! Now with all of this going on, not being able to make an appointment with this new personal trainer, not have phone calls returned, I HAVE HAD IT! So, I re read my contract and there are 2 ways to get out of a contract 1. A note from a Doctor, 2. Relocating more than 25 miles away from any Ballys location. So, I made an appointment with my doctor for a physical, and she found it necessary that under her medical care I should not be working out. I took the note into Ballys and they said they would need to submit it to there corporate office for review, and asked me if I had a copy of my contract, I said yes, why dont you guys have one? they said no, we had to send our copy to our corporate office to get my contract corrected (from when they screwed it up!) I faxed then a copy of my contract so they would have one. Im starting to think their corporate office is a giant black hole in outer space, because stuff gets sent there, and nothing comes out of it! I am not a wealthy person and I cannot afford to lose this money, I have been jumping through hoops for months now and I keep getting the run around. I have contacted a legal service regarding this, the Better Business Bureau, Tom Martino the trouble shooter, and now you guys. As Ive been doing my research Ive found many people with the same problem, even in the industry I work in (mortgages) there are so many people that have Bally Total Fitness on their credit reports as out standing debt, and when you ask them about you get a similar horror story to what I describing now. How can a corporation like this stay in business, when all they do is screw over the consumer? I wish someone would help me and others like me, because Im not the first and I certainly wont be the last! Thanks for listening, TO BE CONTINUED Lindsay C. H

My contract ended Sept. 9th 2007. They continued to take money out of my account without my authorization. They owe me $126.84. They won't give me my refund. I've filed fraud with the bank. I've canceled my debit card. I've filed a complaint with the BBB. Tomorrow I will be filing a law suit against 12440 East Imperial HWY, Suite 300 Norwalk, CA 90651 From: Message Author (click here to email author)Date: Thursday, 10-Apr-08 12:58:40 CDT Business: Reply Online Consumer: Comment On This Comment On ThisWell if bally's took out more than they should you can dispute that with your bank. the bank will actually give back your money and fight with ballys about it. if you did not authorize fo 300 to be taken out you should contact the bank. i am positive they have to give back all your overdraft fees also. ive gone thru this with ballys myself. its alot easier if you call the bank tell them you want to dispute the 300 and the 2k theyll ask why and tell them the truth. you havent gotten service for the money you put in! do it and itll work!
