Simmons Mattress/Sleep Train

 

I purchased a top of the line Simmons Beautryrest Pillowtop in May 1996 from Sleep Train in Sacramento California. We covered it from the first day we owend it with a Simmons mattress cover. We flipped it and turned it as directed. It began to develop dents where we sleep, no matter how often it was turned. Finally, last year (2003) I contacted Sleep Train.

 

They sent out an inspector who found the indentations to be beyond what is necessary for replacement, however we recieved a letter from Sleep Train denying the warranty request because of stains. I then emailed Simmons with the complaint and their response, which I have in writing, was "stains always void the warranty." That is NOT what the warranty says, and the stains have nothing to do with the mattress failure. Also, it's illegal to resell a mattress, so why do they care about the stains anyway? I am afraid my only recourse is to replace the mattress and box spring and file a small claims court action against Simmons and Sleep Train. It will be accompanied by a complaint to the state attorney generals office and a complaint to bigclassaction.com. Nanci H

I am in the mattress business currently as well, but i can give you the Manufactures perspective. i work for a competitor, and lets just leave it at that. Stains are a deal killer for any mattress company. Mattress manufactures have to basicly setup a clean environment for the new mattresses to make sure you get something that is clean and ready to sleep on. the reason stains are the deal killer... or warranty killer, is because of health concerns for those handling the returns. inspectors have no way of knowing what the stain is. if we brought that into a factory, and it turned out to be something contagious, that could be something that would cause us to have to stop production, clean the factory and throw out a ton of raw material, not to mention treat sick employees. in the case of the sleep train inspector, its at their discretion if they even touch your bed to begin with. they have the right to turn around and walk out the door after seeing a stain. Sleep Train and Simmons are well within their rights on this one. especially on a mattress that is years old. chances are, the problem was the pillowtop on the mattress anyway. those always flatten out and take body impressions.

What do you mean "this is not what the warranty says" have you read it? I've been selling mattresses for 6 years and stains ALWAYS void the warranty!
