Hymans-Pennyworths 45 Storey Avenue Newburyport, MA To whom it may concern, On 11-14-04 I purchased a pair of Timberland Pro Series Insulated Bibs from Hymans Pennyworths for $94.95. I'm a carpenter and I wore these pants to my job, for only one day. Where I found that the buckles on the shoulder suspenders would constantly loosen while I was working, and this was only remedied by constant tightening. Upon trying to return these pants to Hymans-Pennyworths I was told I needed the UPC code along with the receipt.
I had brought the receipt with me. The clerk also told me that it would be no problem to return the pants, as I had plenty of time before my 30 day refund period was up. I was offered a different brand of insulated pants, but as it would have taken 5 to 6 weeks to arrive, that was not an option. Anyone who works outside in New England in the winter knows where I am coming from. I located the UPC tag and my fiancée attempted to return the pants, since I was away with work. She was told that they could not take the pants back because they had been worn.
The following day my father attempted to remedy the situation; he was refused a refund and was told to return the following day after having washed them, and after the store manager had contacted the manufacturer. My father returned the following day with the washed pants and a copy of the Massachusetts General Laws concerning store returns and consumers' rights. The store manager told him that he could mail the pants back to the manufacturer himself, and await their decision. The store manager again refused to refund the price of the pants.
It is my opinion, from reading the Massachusetts General Laws (MGL - Chapter 106, Section 2-314) concerning consumer protection, that the store was required to refund my purchase price as the pants were defective and did not function properly. I do not think that it is right for a vendor to require a dissatisfied customer to make repeated return trips to the vendor, each time with a different set of requirements for refund, and to be refused each time. We have been back to that store four times, and still have no refund.
I have now written a 30-day Demand letter, required by the small claims court process to Hymans-Pennyworths with the intent to take them to small claims court to resolve this problem. I have received a reply to my 30-day Demand letter stating that I did not have the receipt (untrue) and that I had told the clerk that I was not happy with the pants. What I had said to the clerk was that the pants were horrible because the shoulder straps kept loosening. Obviously this company has their own agenda and does not feel responsible to their customers. I feel I have been swindled and will never shop there again. William S Newburyport, MA.
