OK, it all started about 4 months ago. My husband and I were getting phone calls 3-4 times a day that said nothing on our machine except a name 'Robert' and a reference #. We did not call them back because on our machine it clearly states that if you do not leave a very specific message you will not get a call back (We are on the national do not call list).

 

About 3 weeks later I get a call at work from 'Robert', at the time I was on break and my supervisor answered the phone and asked if he could take a message, 'Robert said it was personal, my supervisior told him I was not to take personal calls at work unless it was an emergency. 30 minutes later 'Robert' called back. I told him to call me at home, he said he couldnt do that because they only call once, I told him that was a lie because he had been calling 3-4 times a day for the last 3 weeks, I then told him to send me a bill and gave him my new address....very slowly, so he wouldnt get confused he then said that he would send me a bill to"see if I wanted to pay it".

 

That evening he called back, but this time he said on my machine to stop playing games and that he talked to me that afternoon....now that I knew who he was I immediately called back. I once again told him to send a bill and to not call me at work again and to not call my home again....he then threatened to call my husbands work....I handed the phone to my husband and he( my husband ) told them not to call him at work and to him to send a bill numerous times then 'Robert called my husband a dead-beat. We never got a bill.

 

Three weeks later we got a writ of garnishment. We still never got a bill, but I started to get worried about it and started to make payments of $50.00 to Quick Collect. I then reported them to the Better Business Bureau, the Department of Justice, the Department of Licensing, and the Attorney General. I got an email from Mr Donald at the Department of Licensing. He helped us out a lot, we never did get a bill, just something that looks like a made up ledger of totals of what was paid and what the insurance paid....NO BILL. Then after making payments for a few months Quick Collect Stole my WHOLE bank account....wiped it out clean, more than what the amount was for.

 

We were devastated!!! We had nothing for 2 weeks, we were begging gas and food from the tiny little rural store accross the street. Well needless to say, we took them to court and won. The judge said they were to send back all except $290.00 and in court thier, repersentative said that they would accept $100.00 payments. So when we got the check from Quick collect which was suppossed to be $761.00 and it was only $661.00 we assumed that the $100 that they didnt send was the first payment. So 30 days later I sent another payment of $100.00, 3 days later they started to garnish mine AND my husbands payroll for 25% EACH....they took a total of $1911.00, they sent back $311.00 to my husband and $108.00 in a check to me and then $215.00 to my payroll, but, that still leaves over $400.00 that they over took on an original amout that was only $874.78.

 

Now, we have spoken to Jaysen Reynolds, at the Oregon State Bar, and 2 other attorneys and they all say that that we have another very good case against them on many arguments..........., Breech of contract....because they were accepting payments, Threatening to call my husband at work....against the law to threaten, Demeaning language.....they called my husband a dead-beat....against the law, Taking more than they are owed .... against the law, And the collection of any amount (including any interest, fee, charge, or expense incidental to the principal obligation), they hand wrote in a NSF charge on one of the writs they sent us, one of the attorneys we talked to said that that is very illegal. All of which are violations against the Fair Credit Collections Act. We have sent them an offer to settle for the amount they over charged us plus the $352.00 in bank charges that accrued when they raped my bank account, but it looks like they are ignoring that. This company has been negligent to say the least. We will be taking this company to court as soon as we can find a lawyer who will take the case on a contingency basis or Pro Bono(preferred). They have put us through hell for the last 4 months and something needs to be done about it.
