I am attaching a copy of the letter that I sent to Lucille Roberts corporate office in New York. I was totally mislead and am awaiting a refund for my canceled membership.

 

To Whom It May Concern: I, Kimberley Madalena, wish to cancel my membership with Lucille Roberts of Kearny, New Jersey. I am enclosing the original contract/receipt that I had received as well as the membership card, power bands, and literature pertaining to Lucille Roberts of Kearny, New Jersey. I became a member on April 10, 2004. Jessica C L. was my salesperson. She explained the various packages that were offered and I explained to her that I was interested in a monthly-non-commitment type contract. Jessica C L. showed me a flyer with a registration fee of $49.99 and a monthly dues fee of $39.99. She told me that I would be required to have the $39.99 monthly fee electronically transferred from my checking account. I agreed to the $49.99 registration fee and $39.99 monthly fee as well as the electronically funds transferring from my checking account of $39.99 each month. When I signed the electronic pad it stated - If I agreed to the electronic funds transfer, which I agreed yes. Jessica C L. then told me that I owed a total of $90.03 to Lucille Roberts. In my mind I did the math and given the fact that I was told that the registration fee was $49.99 and the monthly dues fee was $39.99, the amount of $90.03 appeared to be fine. Jessica C L. then printed out my contract/receipt. I was told that I could begin working out that day. I used the bicycle for approximately 35 minutes. Upon leaving the gym, I went through all the paperwork, literature, etc… that I had received from Jessica C L. I noticed that there were Power Bands given to me. I assumed that the Power Bands were complimentary until I looked at the contract/receipt. I was never even asked if I wanted to purchase this item. It was just added to my bill. I then reviewed my bill carefully and it was then that I noticed that the prices were different from the prices that Jessica C L. had told me. You will see on the contract that I was charged a registration fee of $39.99 instead of the $49.99 price that I was told, and a monthly dues fee of $45.98. I was told my monthly dues fee would be $39.99. I didn’t even understand where the amount of $45.98 came from, as this was not a figure that Jessica C L. discussed with me. I then went on to view the rest of the contract/receipt. I noticed that the EFT Payment Schedule was completely incorrect as well. It stated a monthly fee of $45.98. The first date was 05/10/2004. This date would be correct. However the next six lines contained payment dates of 04/10/2005, 04/10/2006, 04/10/2007, 04/10/2008, and 04/10/2009. I did not agree to this type of contract. These dates are in consecutive years, not even consecutive months. Not only did it contain that error but I also agreed to a No Commitment Membership No Contract. Why would the EFT Payment Schedule be listed for the next six months if I were a month-to-month member? After viewing this information I called Lucille Roberts of Kearny, New Jersey. I spoke with Jessica C L. two times. During our first phone conversation Jessica C L. explained that my monthly fee was going to be $39.99 and to disregard the paper I received because the computer just printed it out wrong. I then asked her about the $45.98 fee and where that came from. She stated that she gave me a $5.00 discount on the registration fee. If the registration fee were originally $49.99, this would have only been a $4.01 discount, a discount that I did not ask for, nor was told about until I questioned this contract. I then asked Jessica C L. if I could come back to the gym to receive new paperwork with the prices that I was originally given.

 

She stated several times that it was just a computer mistake and that I shouldn’t worry about what the paper stated. I explained that I was holding a contract that stated I would have $45.98 taken out of my checking account each month and that it was not the amount that I had agreed upon. She responded that it was the computer’s fault and that she couldn’t go back into the computer and change it. I then asked her if the computer makes mistakes on all the contracts and her answer was no. She said she would give me a phone number for Lucille Roberts Customer Service so that I could speak to them about this problem. I told Jessica C L. that I had that telephone number and was going to call as soon as I hung up the phone with her. I tried to contact Lucille Roberts Customer Service, but there are no business hours on Saturday. I felt that I had been lied to so I called back Lucille Roberts of Kearny, New Jersey. Jessica C L. told me that she could not help me; the manager would have to handle this. She told me that the manager’s name was Jocelyn. Jocelyn was the original person that I scheduled an appointment with to discuss my gym options on April 10, 2004 at 10:30 A.M. However, Jocelyn was not in the gym and Jessica C L. was my salesperson. I asked to speak with Jocelyn but Jessica said that I would have to wait until Monday to speak with her because she was not there on Saturday when I joined and the Gym was closed on Easter Sunday. She told me that Jocelyn could handle the situation and that she would be able to go into the computer and make the corrections. Jessica C L. stated that she would leave a note for the manager so that she could handle it. She told me that Jocelyn would be at Lucille Roberts of Kearny, New Jersey on Monday from 9:00 A.M. until 1:00 P.M. and that I could speak to her then. After spending a good deal of time on the phone with Jessica C L. I told her that this was my first day with Lucille Roberts and the way business had been handled had left a very bad taste in my mouth. I stated that I was thinking about contacting the Better Business Bureau regarding this matter. I also stated that I was contemplating canceling my Lucille Roberts membership. Jessica C L. simply responded that I could come in and speak with the manager on Monday and get a refund if I wanted to. I ended the phone call by asking Jessica C L. if the information that she would be leaving for the manager would be the correct amounts that she had stated to me and not the amounts that were on the contract/receipt I was holding in my hands. She stated that she would include that information. After carefully reviewing the cancellation of membership process I noticed that there is a capitalized statement “ NO MEMBERSHIP CAN BE CANCELED AT THE CLU OF ENROLLMENT. CLUB PERSONNEL CAN NOT CANCEL CONTRACTS. Jessica C L. once again gave me the wrong information. Had I not read the contract carefully I may have gone to the Kearny location of Lucille Roberts expecting a full refund of $90.03, to sadly find out that I would have to send a signed and dated written notice of cancellation by Registered or Certified Mail Return Receipt Requested to Lucille Roberts before midnight of the third operation day after receiving a copy of this contract. (I am sending this express mail so I know that it will be received well before April 14, 2004) I would like a complete refund of $90.03. I would also like the electronic funds transferring to stop. This is my written letter of cancellation along with the incident that took place that led me to cancel this membership. I believe that I was taken advantage of. I do not wish to be involved with an establishment that handles business this way. If you would like further information regarding this issue please contact me. Respectfully Yours, Kimberley M

I had a very similar experience at the Audubon, NJ location. Names, dates, and prices are slightly different, but the situation is very similar.

I've sent an e-mail through the website, months ago, and have yet to receive a response. I don't feel comfortable going back to the gym to ride out my contract, even if the dirty, crowded conditions were improved, because the staff is so rude!

If anyone has any information on who I can speak to about this, please forward. It would be greatly appreciated.

I wish I had known that this was such a problem when I joined. I also signed up for the month to month, no commitment. However, now that I want it to stop, I can't seem to get any response. I have tried calling customer service (that number is always busy), I tried calling the 800 number that is advertised on the website (that number is disconnected), I've tried emailing (I get no response), now I'm about to send a certified letter (will I get a response to that???). Funny how I can't get in touch with them, but they keep sending me emails about sales and "tell your friends", etc. And of course, they keep taking my money. I would never ever advise anyone to join Lucille Roberts and if I hear of anyone who is thinking about it, I will certainly advise them to definately steer clear. This most certainly boarders on unethical business practices.

Because Lucille roberts advertised itself as a NO Contract gym, I thought it would be appropriate to work out while on vacation in the US. I told the representative at the gym that i would only be here for a short while and so only wanted one month to work out. I paid the registration fee and took a monthly membership on April 24, 2008. To my surprise I found my credit card was charged on $53.29 May 27 2008. I called the customer service number, only to be greeted by two very rude and obnoxious representatives. They told me I signed a contract and that I did not call within three days to cancel. I let them know that I couldn't have signed a contract when it was a "no contract" membership. After much run around on the phone they told me my membership was cancelled and my credit card would no longer be charged. Imagine my surprise when I received my new credit card bill to find it charged another $53.29 on June 24 2008. What recourse do I have, I do not live in this country and will be leaving soon?

I became a One year member of Lucille Roberts on 11/08. I was paying my fees fine until July 2007 i lost my credit card and i never really went back to Lucille's to update my credit card information. I knew my contract was going to expired soon, so i kind of just let it be. I called a week ago since the summer is here and i wanted to know how much was my balance and i was going to paid for it. and she told me it $392.00!!!!!! I was like how so? i had one year contract, and i made very clear to the saleperson that i just wanted for a year. She gave a me a phone number to called. i tried calling for a week, i always got a busy tone. the lady i spoke to was very rude. she told me that i needed to cancel, but i told her that i had a contract for one year, i never received anything in the mail stating my past due fees or anything. and she hang up on me!!!!!!!! can we do something about this already???

I just had a very horrible incident with Lucille Roberts. I rejoined the club 1 month ago, and the new membership will be effective on 06 15 2008. I was told that if I paid up front I will receive free teeshirt, waterbottle and a discount. I said sure no problem and paid up front. Little did I know that apparently I was signing to some type of a contract. Never was I told this at any time! Lucille Roberts advertizes itself as no contract GYM, it has posters of no contract on the windows of its club. I agree, I should have read the fine print, but it never occured to me that anyone would withold any information from me. I called today, that I want to cancel my membership. I spoke with a very rude costumer servive, I asked to speak with the menager. Her name is Carolyn 1108. I tried to explain my story that I was not informed about any contract. She was not listening, and blamed me for not reading the "fine print." I tried to explain my end of the story, haw I was not fully informed, and paid in full up front becouse of free water bottle and a tee shirt. She hung up on me. I cant believe this was a response from a menager. I will contact a lawyer. Costumers be aware. Plese read everything thats on the paper. Do not trast what the sales representatives tell you. It probably is not real. Dont trust anyone who tells you there is no contract. Please read everything and make sure it states no contract on th PAPER, and not someones word. I a sorry that I had this experience, and that this is allowed in The United States of America. If anyone had similar situation pleasae respond to this. Perhaps as a team we can end this froudulent buisness practice. Thanks, Angelika

I have also had horrible problems with this Health Club. I called the 'corporate headquarters' at 212-734-9717 in 2/08 to inform them that I was pregnant and would no longer be able to use my membership (which was due to expire in 3/08). I was told 'OK, we will take care of it, thanks for calling'. In 4/08, I received a letter stating that I owed 78.72 for delinquent dues. I once again called 'headquarters' and spoke to Colette and her 'supervisor' Carolyn, both of whom were completely rude repeating that a call had never been made to them and that my membership would cancel at the end of 5/08. They also stated that I would be responsible for late fees totaling over 100.00. I can't believe that a company or it's so-called customer service dept would operate this way!!!!!!! I will definitely be filing some complaints against this company.

Please contact me via this site so we can look over this item together. At this point in time I hope you received a refund, if not I will refund 110% of the money owed to you. I looked for your contact information after the last line of your complaint, but found none. I hope this message is forwarded to you via this site and I also wish I had seen this sooner.


The reason we print consecutive year numbers on that receipt is so that on a month-to-month membership we want you to know we will not raise your monthly dues beyond what is printed on your receipt as long as you are a member of ours. It in NO WAY commits you to any term or obligation to stay with us as a member. Although we know the longer you stay with us as an active member the better you will feel and look, we would never want to keep you past your comfort period on a No Contract Membership.
