RE: National Credit Audit Corporation (Peoria, IL) - unwanted Saveur magazine subscription
Text of letter send to National Credit Audit corporation. This is obviously a scam, and LOTS of people have registered complaints on various websites but it goes on. Is there anything that can be done? I can see lots of people just mailing in the money and these people getting rich on the backs of the gullible. Text of letter is below.
Mr. Seymour Cardoza General Manager National Credit Audit Corporation 8600 North Industrial Road Peoria, Illinois 61615 Re: File No. 006-10821-01790-219-706(03) December 10, 2001 Dear Mr. Cardoza: I write in reference to your collection notice of 11/26/01, in which you request that I submit payment of $19.95 for a subscription to Saveur magazine. As I did not request subscription to Saveur magazine, I am compelled to dispute the validity of this debt. Furthermore, it appears that your agency is in violation of federal law with regard to the attempt to collect this supposed debt.
You are required to provide:
o The name and address of the collection agency;
o The amount of the debt, stating the original debt and a breakdown of other costs or interest;
o The name of the creditor to whom the debt is owed;
o A statement that unless you dispute the debt within 30 days after you receive the notice, the agency will assume the debt is valid;
o A statement that, if requested within 30 days, the collector will provide the name of the original creditor, if different from the collector; and
o A statement that if you notify the debt collector in writing (within 30 days of receiving the notice) that you dispute the debt, the collection agency will get verification of the debt and mail it to you.
Furthermore, since I am notifying you that I dispute this debt (in spite of the fact that you did not inform that I could do this, as you are required to do by law), Once the collection agency receives written notice that you dispute the debt, it must stop collection of the debt until it has proof that you do owe the debt and sends that proof to you. Please remove me from your files and inform the publisher of Saveur (whose name you did not provide in your letter, in violation of debt collection laws) to cease sending me bills for a magazine I did not order and do not receive. I hereby request that you not contact me again except to inform me that you will no longer pursue this issue or to notify me of a lawsuit. I presume you can figure out that in asking this, I am exercising my rights under the Fair Debt Collection Practices Act. Yours Sincerely, Ginny Tucker

I have not been at the address in Beachwood, NJ for a while and have never received this magazine. If you are sending it to 1145 Ocean Avenue, Beachwood, it will be received by my ex-husband and probably discarded. Please rectify this erroroneous subscription and invoice. Thank you for your attention. Ms. Gloria Pietrangelo From: Message Author (click here to email author)Date: Tuesday, 18-Sep-07 13:42:15 CDT Business: Reply Online Consumer: Comment On This |
