RE: Boiler installation by unlicensed contractor - used license number of Stuar Wachtel, Brooklyn, NY
On or about March 2000, I contacted Tzvi Sashitzky knowing that he is a licensed plumber. He was performing jobs for the company that I had previously worked. I specifically asked for his plumbing license number. A license number was needed to get a free boiler from the gas company. He prepared the contract for me and presented the license number 0886429 as a plumbing number. After the job was "completed", the "imaginary inspector" reviewed the job and "requested " another vent be installed for which I paid an additional $260.00 (check #1844) which not in our contract. The law requires that I do a boiler inspection for the building department every each year. Between September and December of 2000 I tried to contact Mr. Sashitzky, leaving him constant messages on his answering machine but he never returned my calls. I had no choice but to look for another plumber or I would have received violations on the building. The new plumber that I hired to do the inspection informed me that no paper work was filed with the building department on my behalf.
That the work was done by a home improvement licensed person illegally and the boiler was obtained under someone's license. By investigation this matter further, I found out that Mr. Sashitzky used the license of Stuart Wachtel & Son Plumbing, license # 331, located at 1354 East 64th Street, Brooklyn, NY 11234. I spoke with Mr. Wachtel twice. In our first conversation he did not know any Tzvi Sashitzky and was ready to arrest him for illegally using his license. He asked me to fax him the contract that Mr. Sashitzky gave me. The next time I called him to get his fax number he told me that he gave Mr. Sashitzky permission to use his license. I would like to know what is legal from this and what is not. I feel these people took advantage of me and would like something done about it. Please let me know what I can do. Should not Mr. Sashitzky be punished for misrepresenting himself to people not familiar with licensing laws and the construction business.
