I recently migrated from Jamaica to New Jersey. I paid a deposit of $500.00 to Wayne Village as a deposit on an apartment. I later discovered that my 11 year old daughter would be the only African- American female in a school of 1100 + students.
This overwhelming situation would be too great a shock for her so I withdrew the application for the apartment, but the Lessor has refused to refund the deposit on the grounds that I signed the application agreeing to forfeit the fees if I were to withdraw the application.
Thre is a clause in the lease agreement that makes a provision for a refund if the tennant is disastified with the apartment or if there is an unusual circunstances.
I think that the unusual nature of the school situation for my daughter warrants a refund. I am in great need for the money. Thanks for your help.
