RE: Bellach's Leather Furniture Superstore, Santa Clara, CA - paid for furiture in Sept. 2002 that is still not yet delivered
Subject: Bellach's Leather - purchased furniture which is not delivered yet Address of the store: Bellach's Leather Furniture Superstore 4695 Stevens Creek Boulevard Santa Clara, CA 95051 408-248-0600 My husband and I purchased a sofa and 2 ottomans on Sept 2002. The salesperson explained that it would take approximately 8-12 weeks for delivery. Since we didn't hear anything from them about the delivery, we went up to their showroom which is in Steven Creek for the status of the furniture, Dec 2002 (after 12 weeks of puchase) .
The customer service representative told us that because of the Dock worker strikes the orders are delayed for another 12 weeks. So according to them it should be delivered by Feb 2003. And the customer representative gave us the corporate office phone number with the order number and told us to contact the corporate office for any further information. We waited for another 12 weeks and have not heard anything from them.
Therefore, we called back to the corporate office on Feb 2003 to check the status but to our surprise found out that it will take another 8 weeks or so and the latest date given by them is mid April 2003. Now I am suspicious that they will never deliver our furniture. I already made a payment of $489.31. So I tried to cancel the order but they will not do that also. When I talked with the Bellach's Leather furniture salesperson again he mentioned that there are total of 75 customers whose orders are delayed and I am the only one who is complaining. He also said that there is no upper limit on the delivery time so under some circumstances it may take upto 100 years. They promised delivery in 4-5 months. Yesterday we received a bankruptcy notice in the mail. Now what do we do? We are copying this mail to the bankruptcy attorney james.a.shepherd AT usdoj.gov From: Message Author (click here to email author)Date: Tuesday, 25-Mar-08 10:53:25 CDT Business: Reply Online Consumer: Comment On This Comment On ThisHere's my version... Ordered a sofa in Sept '07, its now March 20, 2008 and Bellach's just filed for BANKRUPTSY, No. 08-10362 AJ. James A Shepherd is the acting U.S. Attorney, james.a.shepherd AT usdoj.gov. I encourage everyone to register an objection to converting Bellach's petition to a Chapter 7 proceeding. If they switch from 11 to 7, we could all get little or nothing back. The phone numbers for Sales Manager Mike Reynolds are 415-599-9069 (cell) and 916-782-2800 (office). Good luck and post updates...! I ordered furniture in early November 2007, paid a 50% deposit and was promised a delivery before Christmas. It is now March 12, 2008 and I have nothing. I have asked for a status on this order on 18 occasions. I have not received one reply. I have stopped by the Rocklin Store trying to resolve this and get nowhere. Michael Reynolds have been belligerent, combative on the two occasions a confronted hem in the store. I think this company is running a scam and has absolutely no intention of ever delivering anything. Our sofa was delayed months and I had to make numberous calls to get information when calls where seldom returned. They makes used car salesmen look like saints. Ordered a sofa sectional on 7/29/07 and told 8 to 12 weeks for delivery. No one ever caled to say that it would be delayed. Every time we've called, there was another story as to why the sofa hadn't been delivered. The main reason was that the fabric was out of stock. Now, on Feb.5th we demanded a refund of our 50% deposit and were told by Michael that he would process it. One week later we were told by Cindy that she hadn't received a credit memo and that it had to be initiated by the store manager or salesman. We called Meenu (salesman) at Steven's Creek store and he said no one had asked him to issue a credit memo. After pressing Meenu, he said he would fax it within 30 minutes. One hour later the main office said they had received it but it would take another week to send to outside accountant for processing. Today is 2/25. Supposedly our credit memo was sent to the outside accountant 10 days ago. Still don't have credit. Today Cindy said that accountant only processes credits twice a month and that we would have to wait till end of month. I assured her I would call on the 29th if I don't see a credit. I have threatened small claims court action several times - dosn't mean a thing to them! After finding this website and seeing all the complaints about Bellach's I have to admit I'm realizing we'll probably never see our $. I think we should all go to local TV consumer help guy - if nothing else we may be able to save someone else from going through what we all have! I too ordered in Aug. 07 and was told 4 months (coming from Italy). The shipment FINALLY arrived at the end of January and then I'm told that the container was damaged. When i asked Michael Reynolds (GM) which pieces (of 3) were damaged I never received a call back. I have since tried cancelling my order and have contacted the corporate office. If I do not receive my refund I will be filing in small claims court or with others a Class Action Lawsuit... I know of another family in the same situation and he's a lawyer! I have attempted to cancel this order but have been told this can only be done by GM Michael Renyolds, I have called several times and left messages he has yet to return one call. Anyone have ideas about what can be done about this horrible company? These guys are running some sort of round about scam where they get your deposit and never deliver. I ordered my couch in Aug 2007 withan 8-10 week delivery estimate and it is now Jan 2008 and they are still not delivered or even at the warehouse for that matter. These guys always have an excuse.
