Date: Monday, April 02, 2001 09:24 PM On Monday, April 2, at 5:22pm, a Bank of America representative by the name of (Eric)called my home. When I answered the phone he was very beligerent. He would not identify himself until I asked who he was asking for my wife. Then HE asked ME who I was. After letting him know I was her husband he tried to explain the purpose of his call.

 

That our car lease was behind. I let him know we knew this and that we were going to make a payment this friday, April 6. He wanted to call my wife at work and I told him that she could not receive calls of that nature at her job and neither could I. He started to argue with me so I hung up on him. He called back about 5:24pm and THREATENED ME! He said, "MR. STANLEY, DO YOU WANT TO KEEP YOUR CAR?" I told him he just threatened me and I asked for his supervisor which he said was not in. I would hate to get into legal aspects of this but what he did I believe is against the law. I don't think late payments deserve to be responded with threats.

 

No, we don't want to lose our vehicle and we are trying the best of our ability to pay EVERYONE that we owe. We are having some financial problems right now and we are behind on everything. I mentioned all of this to that guy ERIC. Please respond in a timely manner so I can know what actions I need to take. I have made a copy of this note and intend on using it and whatever recording ERIC may have made of the phone conversation. Thank you. This is the second time I have had to contact someone about a Bank of America rep named ERIC. On April 2, between 5:30pm-6:00pm, ERIC called my mother-in-laws house looking for my wife. How he got her number I do not know. He continued with his threats telling my wife that he 'could hunt me down if he wanted to.' He continued to tell her that she could get money to make her payments from credit cards, family members and the like.

 

Making suggestions of this nature is a procedure that phone operatives are not supposed to use. This guy, ERIC, is now officially on my nerves. SOMEONE of authority will here of these incidents and SOMEONE will be contacted. I do not wish for this guy, ERIC, to call my home again. If he, ERIC, does call my house, my job, my wife's job, my mother-in-laws house, or anyone that I know, legal actions will be taken.
