Managment breached agreement, refused to respond, was negligent at handling complaint, placed my health at great risk, and defamed my character. To this date, they have not responded despite my numerous attempts to resolve such issues after the regional manager Belinda Clark asked me to work with them and promised not to charge me for the ongoing water damage, possible mold infestation, and poor air quality experienced in my apartment causing me to go to emergency hospital twice, have an anaphalactic attack, having to carry an Epi-pen and having ongoing lethargy, headaches and other problems related to possible mold contamination according to my doctors report. I have all supporting documentation and communication between managment and I. See below which is a email received from Belinda Clark stating they would not charge me, but to my surprise, I learned she breached her agreement and I had absolutely no idea. I have had the police involved other agencies trying to resolve this issue. I have filed a complaint with the BBB, FTC, Attorney General, Rip-Off, Scam-Sham, Consumer Complaint agency and now this. My next step is a lawsuit. All I have requested is that I be made whole, to resolve me of the debt they are now charging me for and to reimburse me for few pieces of furniture I had to leave in my unit due to possible infestation. Please note, I have had a perfect bill of health. I have never suffered from any form of allergy, rash, outbreak, breathing problems or anything. All of my symptoms started nearly 45 days after I moved in. I pointed out the potential water leak the day I moved in and managment assured me, their was no water leaks or damage despite the obvious water bubble in the ceiling. I pray I be made whole, that is my my only relief sought for now.

The following email was one of the emails received from Belinda Clark the regional manager.

Good Morning Ms XXXXX:I am back in the office today from being out on PTO. I have not had the opportunity to talk with Misha this morning to get all the details regarding your complaints. As mentioned in your email, you have begun packing and are moving out. I will make sure to put a note in your file explaining that no cancellation/notice fees are to be charged to you.

Hello XXXXX: Before you authorize any inspections, please allow me to assess the damage and speak with you regarding the issue in your apartment. This will allow us to determine our obligation as the landlord and your obligation as the tenant. Libby Jansen (Regional Vice President) and myself will be available to meet with you on Wednesday, January 19th anytime between the hours of 8:00 am to 5:00 pm. Please let me know what time works best for you. In the event that you are not able to meet with us on Wednesday, we can still inspect your apartment and discuss with you over the telephone.

Hi Belinda,

Thank you for acknowledging my previous email regarding my mold issues in my apartment. As we discussed, I will be out of that apartment soon. However, although you contacted me acknowledging my complaint and advised me you were out on PTO, the issue regarding replacing my furniture has not been addressed. Because I have not heard from you regarding replacing my furniture, leaves me no choice but to have my apartment inspected by a licensed mold inspector. This test will cost me $600. I will also contact the EPA and other health regulatory agencies to have them come inspect my apartment, as each time I go over there just to gather some of my belongings, I get sick, literally.

I am not sure you are aware that it rained in my apartment again in the same area you had them replace twice since the work you had done. Your maintenance crew came in and saw where the water damage was and only drilled holes in the wall but never came to dry it out or replace the wet Sheetrock or carpet which caused re infestation. So, when you turn on the heat or air I think the mold spores multiple quickly. It affects the air quality and my breathing. It causes me to be extremely lethargic and head achy. I have asked your staff several times if the air ducts were cleaned out because of this problem each time I turn on the unit. Yet, they think I am just a complainer instead of investigating my claim.

In any event, I am not sure you all truly understand the hazards of mold and the damages it causes but it is serious. It can not be cleaned out of cloth material and thus, furniture must be properly disposed.

Once my complaints are validated which I am 100% confident they will, I will contact an attorney who specializes in mold and pursue a law suit.

I have tried to work with you all and just wanted to be made whole but you all seem to refuse to acknowledge my request. Again, when you look at my furniture you will see it is in excellent condition and I would have no reason to replace it except for the mold contamination. I will have a mold inspection this week and I will forward the bill to you all as well as the results,.

Once all testing is completed, I will be completely out of that apartment. I will leave the items I can not take there in the apartment for disposal.

Again, to avoid a lengthy costly lawsuit, you all can agree to replace my furniture and once I'm gone, this will be over. However, if you refuse to acknowledge or cooperate it leaves me no choice but do what I must to make me whole.

A reply would be appreciated.

This is my third request.
