We booked our office premises with Dattani Plaza in Oct. 2007, with posession of the premises assured by end 2008 latest. The Bldg., consists of three wings, A, B and C.

A wing which is road facing was completed long time ago, fully occupied, after which they started the booking for remaining B and C wing. There appears to have been some dispute with the A wing occupants due to non-compliance of the promises by the builder.

As to our premises, we paid 50% payment in advance after which the agreement was signed and got registered. Waiting and waiting, after so much delay, they started construction work on C wing which is the front side of the building, giving us the assurance that the B wing work will start soon after, to our shock and surprise that B work never took off, C wing work is in the final stage, B wing work is not likely to commence in the near future.

Now that the commercial property price is in the range of Rs.10,000 to Rs.15,000/- in the area, there is a very remote chance that they will start the B wing work now. We are left with no property which has been booked by us, except the sale agreement duly registered. In the process, we continue to lose on interest and depreciation benefit as we are not in a position to capitalize the property investment made. The initial payment made together with interest and other losses now work out to about Rs.1.25 crores.

The builder is now coming out offering us alternate property which is much lower area than our booked area, at C wing, the work is in the final stage, no concrete proposal is forthcoming, except talks in the air. We have demanded compensation of Rs.15 lakhs plus the alternate property duly stamp duty paid and registered without paying any single penny extra.

We thus continue to suffer monetary losses due to failure from the builder part to honour the commitment made by them.

Can the forum suggest some remedy to get the compensation and our money back from the builder. Simon /Multimodal Freight System Pvt. Ltd.
