Bank of America Closes Account Without Notification

I opened an account with Bank of America back in October 2008. I thought it was going to be a new great bank and how quickly that thought disseminated. I was logging on to my account online yesterday afternoon around 4pm and my password was not working. I figured it was not working because I had added a joint account the week before. I called Bank of America as I was instructed to do so online. When I called I was told that my account had been closed. I was in shock and startled because there wasn't any reason. I asked the representative the reason behind it and they couldn't disclose anything to me. Why?!!! I'm the account holder. Once I was off from work I drove to the closest branch.


So you have a better understanding of my situation, my father lives in Baldwin Park. He was stricken with several infections back on Thanksgiving 2008 which caused him to go to the hospital. Unfortunately, his memory became very clouded so he became incoherent. I went to visit him in the hospital and realized he wouldn't be able to manage any payments he had to make so I decided to do that on his behalf. I drafted my own power of attorney and a friend notarized the document. I had to sign on my father's behalf. As crazy as this may sound because legally it's "fraudulent" I had to do it otherwise nothing would get accomplished. I had to payout my dad's landlord so I make my way over to Bank of America in Baldwin Park and told my story to the manager. He understood the situation. I gave him the original power of attorney for review. The legal department rejected it because it was too vague. Then I went ahead and asked what else I needed in order to pay his landlord and he told me there was an internal power of attorney Bank of America drafted. If I got that sign and notarized, I could be added to the account. Well again, I had to sign on my father's behalf because he is unable to. Believe me, I tried and he was too weak to do it. So I went ahead and signed it myself and had a notary friend stamp it. The only reason she did is because she understood. Again, I am looking out for my father. I'm not trying to swindle him. I'm a person of high integrity and trust worthy. He would say the same if he wasn't as confused as he had been. Well I sent the POA to BOA and the legal department rejected it because signatures were not matching. Fair enough. The manager decided to cut cashiers check to the hospitals and other parties that were owed. He really went out of his way so thank goodness for him.


Back in Las Vegas, I'm trying to work with Medicaid and Medicare because I'm moving my dad with me. He needs to be taken care of. Between juggling my job and all of my dad's affairs, it's so hard. Well I thought it would be a good idea to open up a joint account with my dad. I went ahead and applied online. Again, I had to have my cousin verify himself as my dad. He answered all questions correctly therefore BOA went ahead and approved the account. I received all the paperwork. The only thing I was waiting on was the debit cards. I figured it was all going to be a walk in the park from here. I planned on visiting Social Security Office once I received all the documentation from the bank and to present my Power of Attorney and discuss my father's situation in order for me to change the account for his direct deposit. Well, Friday January 30, 2009 I'm at work and found out my account was closed! They wouldn't tell me why. I figured it was the joint bank account. When I made it the the financial institution closest to me I received a phone call from BOA Baldwin Park stating that the landlord was there to pick up the final rent check. They were unable to process it because BOA closed my dad's account in California! I'm in a bind because my rent is due, my father's shared cost for being hospitalized is due (No money, no hospital bed) and now the landlord can't be paid! I asked the bank to surrender my money but they wouldn't. A cashier's check would be mailed to me. My rent is due Monday, February 2, 2009 If I don't pay I incur hefty late charges. The refused to discuss my situation and said they would not eat the cost for my late charges. Is that unfair? YES. Now, what about my father? I can't cash his checks! That's why I opened an account with him added on. So I could make his payments. Now I need to call the hospital to try and differ payments. Also, the direct deposit my dad gets at BOA California will bounce back. I need that money to make his payments!!!!! Why didn't anybody from BOA call me to tell me there was suspicion? I could have given them all the documentation to prove this was not fraud. Today, January 31st I will be in touch with my attorney and I plan on backcharging the bank for late fees, pain and suffering and anything else that I possibly could. Instead of working building a personal relationship with a client they stab from the back. My father has banked with them for over twenty years! This could have been such an easy fix but they went ahead and blew it out of proportion instead of calling and asking questions! Now I have to try and pick up the pieces. Way to go Bank of America! You guys are so unethical. I will never do business with you as long as I live!
