Stay Away From Dirtcheapshtuff on Ebay

This person buys and sells on EBay. We sold him items (item numbers 320325863758 & 320325862843) that he claimed he never received and he requested a refund through Paypal. He never did follow up to requests from Paypal concerning the shipment and kept the money. We have neither have the money or items returned to us. Please stay away from this person Bryan Maltzman.

You would not respond to Ebay or Paypal's requests since January 12th, 2009 to say you did not receive the shipment. The only reason Paypal ruled in your favor was because of their policy of negative confimation. I will be checking your listings from now on and if one item of similar nature is listed, then I will be taking the next appropiate step. Remember we did not receive the items back, meaning they were delivered to you. Too bad you are the only person in the 7 years I have been with Ebay that didn't receive their item (sarcasm). If you ever want to do the right thing, then just pay us. Sleep well little Bryan.....

This is what your last message to us concerning the items said:

I do not see anything about requesting a full refund except said in an either/or way from you. Also the item was sold on December 21st, 2008 and mailed to you via media mail on December 26th, 2008. Sorry to say a month did not pass from December 21st, 2008 to January 12th, 2009 in my world. Just admit you were upset at our "patience is a virtue" comment and you felt the need to punish us by keeping our money for items received. Also you did not request and/or pay for any type of mail confirmation. You know you received the items, just admit it. You'll feel better.

I am dirtcheapshtuff. I have been buying & selling on Ebay for almost 10 years. At present, I have a positive feedback rating on Ebay of 99.7%. I purchased 2 lots of CD's from this seller, and paid for them IMMEDIATELY upon the close of the auctions. I emailed this seller about 3 weeks after payment was sent, to let him/her know that I had yet to receive my CD's. At that time, I requested from the seller the date that the CD's were shipped, and the corresponding tracking information for the shipment. The seller wrote back to let me know that the cd's had been mailed, but there was no tracking information for the package. About a week later (this would have been a month or so after having paid for the cd's), I wrote to the seller to let him/her know that I still had not received my cd's, and I requested a full refund at that time. When the seller ignored my request for a refund for merchandise not received, I then filed a complaint with Paypal in order to recover my money. After a thorough investigation by Paypal, Paypal determined that the seller had failed to provide proof that I had received my cd's (which I did NOT), and closed the dispute in my favor.
