Non replacement of defective spacs frame

I have purchased Branded frame with Zeiss glasses on 17/01/2009 wide invoice no. 831482001269 from Shop No.1-D 2-D, Vasant Nivas , Ground floor , Rande Road , Near Dadar (West) railway station Mumbai vide booking ref 1211.

On 30th January ,2009 due to manufacturing defect the frame soldering was broken and therefor i have visited showroom on 31st January,2009 for replacement of frame vide Job work No.10 dated 31/1/2009 S/R. DDR-3148 and Mr. Sunil sales executive has given me delivery date of 2nd Feb,2009 .

On 2nd i have not received any response from show room and hence contacted showroom three to four time and finaly Mr. Sunil informed me that he will revert on 3rd Feb,2009 before 1.30 p.m. However till 4.00 p.m today nobodey has reverted. Upon inquiring it was informed to me that they can't replace the frame claimming that it was not manufacturing default.

I have explained the incident to Mr. Sunil and later on Mr. Vaibhav over his mobile no.9320874222 however both the person are not ready to replace the frame by wrongly claimming that the frame was broken due to force.

I have informed them that the minor band in frame was due to wearing of frame after its one road was broken(soldering was broken) as i couln't able to see without spacs and also i am residing at Bhayander (about 40 Km from dadar) which is far from Dadar.

You are requested to kindly look in to the same as the frame is having warranty and the damage occured because of manufacturing defect as it was not properly soldered.
