Judge Alfred A. Barbalunga

1 Eagles Nest Road
Pittsfield, Ma 01201
US

An internet article dated 2/1/01 spoke of Judge Alfred Barbalunga's decision against Linda Hamilton, a career nurse anesthetist who had a Concealed Weapons Permit, where a truck driver had been manacing her on the Mohawk Trail, which caused her to fear for her safety. She picked up her gun and held it against the steering wheel, looked for a place to pull off the road and call police. She was subsequently charged in the worst case of prosecution that has ever been seen in that Court's history. Judge Barbalunga did not read the Court file, sat like a parrot on a Bench, did not take into account a truck driver's many different versions, listened to a rabid Prosecutor advance the case, took no heed of the Officer's admitted lack of knowledge about handgun laws, and he found Linda Hamilton guilty. She lost her job at the hospital, had her guns taken away, became despondent, and took her own life.

On 10/4/02 I filed a Petition To Review Denial Of A Gun License, in Berkshire District Court; the case was assigned to Judge Barbalunga, and it was called to the docket on 11/12/02, five weeks later. He sat there with a vacant stare which caused me to ask him if he had read my case Petition. He said: "This is the first time I have ever heard of your case." He hadn't read Hamilton's case either. Mine was 121 pages long and criticized Henry Dondi, and Anthony Riello, the Chief of Police, as well as the Massachusetts State Police for their many blunders in investigating my law-abiding background. For example, my fingerprints had not been taken when my Application was turned down the first time. So I filed suit in U.S. District Court in Springfield, against the State Governor, Attorney General, nine of the Gun Control Administrators, the Mayor of Pittsfield, Henry Dondi and Riello. The State defendants pointed fingers at Dondi and Riello. The case was referred to Berkshire District Court, and I gave those clowns another chance to smarten up, but they Denied my Application the second time. Along the way, I found out that the State Police had processed the fingerprints of John R. Walsh, a Parole Officer in Pittsfield, and then put his record in my file. If he had raped a ward of the Court I would be in serious trouble. These "Clowns" are everywhere.

Judge Barbalunga said he would read my file, but he lied, and mailed an Order that afternoon, that almost beat me in getting back home. His docket was full that day, he heard all of those cases, the post office closed, but my Order had that day's postmark on it. Nobody can read 121 pages that fast.

Now, let's examine Henry Dondi's claim to fame as the Weapons Designee for the City of Pittsfield. He never heard of Sergeant York in WWI, he never heard of Audie Murphy in WWII, and he never knew Carlos Hathcock in Viet Nam. He did say that he knew who the Minutemen were in Concord and Lexington. Not too bright!

Did you ever wonder why he now works in Williamstown, Massachusetts? He shot a dog for biting him on the butt. A hero.

Anthony Riello was seen looking-around while he was saluting the Honor Guard, which is no way to salute anything. Did you ever wonder why he moved laterally to be a Chief of Police in Falmouth? It is a good thing that Pittsfield got rid of these two clowns. Any clean citizen can get a Class A License in Lanesboro, Dalton, Richmond, or Lenox and Lee, but not in Pittsfield. Got the picture?

But what are we going to do about Judge Barbalunga? I consider him to be the one person who is directly responsible for Linda Hamilton's suicide. If he had read her file, she would still work at the hospital, and would still be alive.

The responsibility should be shared by a rabid Prosecutor, lying truck driver, and inept and poorly trained Detective.

In my case, I moved across the border into New Hampshire and got my Concealed Weapons Permit in only nine days. I was a combat Veteran of the Korean War, a family man, and somebody who was never charged with a misdemeanor or felony in any State or anywhere in the World. I considered myself to be a "Suitable Person" under all of the factors used to qualify for a Concealed Gun Permit.

Look at: Walsh v. Chief of Police, case number 02-CV-0460 in Berkshire District Court .. to see if it's still there, or see if they had some Clown destroy it.

I wrote to Judge Barbalunga on 11/19/02 and again on 6/3/03, and the President of the Bar Association Louis Oggiani on 10/14/03, but they were too embarassed for words, and never responded. What are Barbalunga's excuses for not doing his job on the Bench, or responding to my inquiries since? If the truth be known, he has a Concealed Gun Permit.

Corruption runs rampant in Pittsfield. I just noticed that Gerard Downing, the District Attorney who knew all about my case, died of a heart attack. Somebody ordered an "Accidental Death" benefit payment ... "notwithstanding laws to the contrary" ... for his family. Heart attacks are listed as Natural Causes, not Accidents. Which clowns set it up, to pay with your taxpayers money?

Pittsfield is my home town, and if you check "Western Massachusetts A History" 1636-1925 on page 328, you'll find that my Grandfather Daniel J. Walsh, built a lot of homes, buildings, roads, and a large segment of General Electic Plant.

His sons and daughters were Engineers, School Teachers, and served Pittsfield in the finest traditions.

The United States Supreme Court ruled that it is an Individual Right to keep and bear arms. Pittsfield buys armored vehicles because the Police are afraid. They can wear bullet proof vests, but you can't. Is crime going up or down in Pittsfield and what are you doing to do about it?
