California Finance Lenders License MORRISON FOERSTER Los Angeles, Ca US WWW.MOFO.COM Dealer Services Corporation (DSC) lawyer and house counsel John Wick testifies that Morrison Foerster attorney Mark Gillett assisted DSC in obtaining a Lenders License on May 27, 2009. That assitance came while DSC was operating as a unlicensed finace lender since 2005. Attorney Mark Gillett's bio claims that Mr. Gillett was appointed by the Commissioner of Corporations in 2003 to advise the Commissioner on recommendations for changes in the California Finance Lenders Law. Mark Gillett assisted in the drafting of a $60,000 settlement agreement between DSC and the Department of Corporations. The Commissioner contends that Discover lending activities to California borrowers were in violation of the licensing requirements of the CFLL. The testimony of John Wick on 8-4-2009 CHAPMAN: Okay. So you submitted the letter -- you're referring to Mark. Who is Mark? JOHN WICK: Mark Gillette is an attorney at Morrison Foerster in Los Angeles that assisted in the submission of a partment my indication. CHAPMAN: Does Mark Gillette -- has Mark Gillette had any prior dealings with the California Department of Corporations? JOHN WICK: I'm sure he has. CHAPMAN: You're not aware of what those might be? MR. NORMANDIN: Objection, your Honor. That calls for an attorney-client communication. THE COURT: Sustained. MR. CHAPMAN: Well, your Honor, I don't think the relationship is attorney-client. Regardless of how the information came, the subject matter I submit is not attorney-client privilege. THE COURT: Sustained. MR. CHAPMAN: Okay. And, Mr. Wick, DSC did not receive a license until May 27, 2009; correct? JOHN WICK: That sounds correct.
