Company Miscalculates Paychecks, Withholds Final Paychecks

Company did not send paycheck for last days worked. When presenting the owner, controller, payroll person and "consultant" with the correct numbers and facts, they conveniently stated that the Pay Periods that have been listed on my checks for over a year were not correct. I have been told by other former employees that this has happened to them also. In my opinion, false reporting of pay periods and payroll may be illegal. At best, this can be considered deceptive business practices and this company is not only ripping employees off, but may also mean payroll taxes are being reported incorrectly. I have written documentation of all the facts and figures I have referred to above. They were indeed audited by tax authorities and they changed their accounting practices to be correct. Which means they were calculating paychecks incorrectly. But they won't do the right thing and pay employees what they owe them. I still have not received my paycheck for the 5-1/2 days I last worked and I also have not received a correction to the miscalculated paycheck I did receive. Employees: check your paychecks carefully! The situation can be remedied easily...pay me for the 5-1/2 days pay you owe me for, BASED ON THE PAY PERIODS WRITTEN ON MY CHECKS, and correct your accounting mistake on the last paycheck you did send me. Also, correct any mistakes you have made on other employees' paychecks because of the same issue. And make certain current salaried employees (and hourly employees, in case there is a similar discrepancy there) know EXACTLY what their paycheck is paying for and those dates are CORRECTLY listed on their paystubs. In my opinion, this is an easy solution, one which could be handled out of court, should this company be inclined to do the right thing, rather than file a frivolous lawsuit. That reason is to let the employee know EXACTLY what dates the pay they are receiving is for. To say then, after I turned in my resignation, that the pay periods listed on my check are WRONG is dishonest and shoddy business practices. Period. You can call me disgruntled all you want but if you were ever audited, you are the ones who will be in trouble with the state. If you are not paying employees correctly, in my opinion, that means you may also be ripping the state off on your payroll taxes as well. Legal action on your part means that your accounting and bookkeeping practices will be open to scrutiny. Are you really certain that is what you want? Statements are generally considered malicious if they are false. I have every single paycheck I have ever been issued that documents my pay periods. Since my statements are true, my postings here are not malicious. They are to warn current and future employees of your bookkeeping and accounting practices. The outside consultant conducted an independent review of her complaint that her final pay was not proper. The outside consultant's review determined that her final pay was in fact proper, that she is owed nothing from the company, and that in fact she owes the company money. It is unquestionable that she is owed nothing from the company, and that she owes the company money. This former employee is knowingly and maliciously putting out false information about the company in this complaint. The company now plans to take legal action against her. The company is content to allow a Court to decide who is right and who is wrong in this matter. There is no question that the company will prevail in Court.
