Jaguar of Novi Michigan won`t fix my car only 28,000 miles two months out of warranty

We took a Jaguar X-Type in for service in April of 08. We told them the car was making a whining noise and it was still under factory warranty. They put a power steering pump on it and said we needed new tires. At that time the car had 26,000 miles on it. We put new tires on it at the cost of seven hundred dollars and put the car in the garage because we don`t drive it every day. We then took it for a small trip and it had the same noise it had when we originally took it in. Now they say the transfer case is bad and it is two months later and the vehicle is out of factory warranty. My complaint is that they never fixed it when it was under warranty. I have been in the automotive business for 30 years and I told them it was not the problem at the time. They mis-diagnosed the actual issue. So now after the dealer contacted Jaguar the factory agreed to pay half of $2500.00 dollars it will cost to fix the vehicle. I feel since the dealership dropped the ball on the car in the first place they should pick up the other half. They want us the pay for it. I feel that they are taking advantage of us and Jaguar. They billed Jaguar for the power steering pump we never complained about. Furthermore when the vehicle was in under warranty we were supposed to get a loaner. They offered a Chevy Metro or similar. This is some way to treat a customer when we bought two $40,000 cars at the same time.
